Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his date of birth (DOB) as 3 November 19XX vice 8 December 19XX. 2. The applicant states his DD Form 214 shows an incorrect DOB. 3. The applicant provides his birth certificate. CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Texas Army National Guard (TXARNG) on 10 August 2010. His DD Form 4 (Enlistment/reenlistment Document) and all allied documents, including a birth certificate and a driver license, show his DOB as 3 November 19XX. 2. In connection with his enlistment, he also underwent an enlistment physical. His DD Form 2808 (Report of Medical Examination) also listed his DOB as 3 November 19XX. 3. He entered active duty for training (ADT) on 28 February 2012 and he completed the required training for award of military occupational specialty 11B (Infantryman). 4. He was honorably released from ADT on 13 July 2012. Item 5 (DOB) of his DD Form 214 shows his DOB as "19XX-12-08" (8 December 19XX). 5. He provides the same birth certificate that was included with his enlistment contract and shows his DOB as 3 November 19XX. 6. Army Regulation 635-5 (Separation Documents) at the time served as the authority for the preparation of the DD Form 214. It provides that the DD Form 214 will be prepared to reflect an individual's service as it exists on the date of release from active duty or discharge. DISCUSSION AND CONCLUSIONS: When the applicant enlisted in the TXARNG in August 2010, his DOB was verified via a birth certificate and entered on his military records as 3 November 19XX. This DOB is consistent with other documents in his service records. It appears when his DD Form 214 was processed his DOB was incorrectly listed as 8 December 19XX. Therefore, he is entitled to correction of his DD Form 214 to show his DOB as 3 November 19XX.
