THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show in: * Item 11 (Primary Specialty) – 45K (Armament Repairer) and years and months he served in that specialty * Item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) – the Expert Marksmanship Qualification Badge with Rifle Bar 2. The applicant states item 11 of his DD Form 214 should list his additional primary specialty title, years, and months in that specialty because it involved a period of 1 or more years. Item 13 should list the Expert Marksmanship Qualification Badge with Rifle Bar because he earned the expert qualification score rating. 3. The applicant provides copies of the following: * Ordnance Center and Schools Mechanical Maintenance Training diploma * Enlisted Record Brief (ERB) * DA Form 5790-R (Record Firing Scorecard – Scaled Target Alternate Course) * DD Form 214 CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army on 10 August 2006. He reenlisted in the RA on 23 February 2009. He served in: * Iraq from 21 July 2009 through 16 July 2010 * Afghanistan from 26 August 2012 through 5 May 2013 2. He provided copies of the following: * Ordnance Center and Schools Mechanical Maintenance Training diploma which show he attended the Armament Repairer course from 12 December 2006 through 5 April 2007 and was a distinguished graduate * ERB which shows in: * Section I (Assignment Information) - his primary military occupational specialty (PMOS) as 15R (AH-64 Attack Helicopter Repairer) and does not list an entry for secondary MOS * Section VIII (Awards and Decorations) – shows the Sharpshooter Marksmanship Qualification Badge with Rifle Bar * Section IX (Assignment Information) - he served in: * duty MOS 45K from 22 August 2006 through 4 March 2012, a period of 5 years, 6 months, and 11 days * duty MOS 15R from 5 March 2012 through 12 July 2013, a period of 1 year, 4 months, and 7 days * DA Form 5790-R, dated 8 March 2013, which shows he earned the expert qualification score rating with the M-16 weapon system 3. He was honorably released from active duty on 25 October 2013 and was transferred to the U.S. Army Reserve Control Group. He was credited with completing 7 years, 2 months, and 16 days of active service. His DD Form 214 lists in: * Item 11 - 15R, AH-64 Attack Helicopter Repairer, 2 years, 8 months//Nothing Follows * Item 13 - the: * Afghanistan Campaign Medal with three bronze service stars * Army Commendation Medal * Army Achievement Medal (4th Award) * Army Good Conduct Medal (2nd Award) * National Defense Service Medal * Global War on Terrorism Service Medal * Korea Defense Service Medal * Iraq Campaign Medal with one bronze service star * Noncommissioned Officer Professional Development Ribbon * Army Service Ribbon * Overseas Service Ribbon (3rd Award) * North Atlantic Treaty Organization Medal * Basic Aviation Badge * Sharpshooter Marksmanship Qualification Badge with Rifle Bar 4. Army Regulation 635-5 (Separation Documents), at the time prescribed the separation documents that must be prepared for Soldiers on retirement, discharge, release from active duty service, or control of the Active Army. It establishes standardized policy for preparing and distributing the DD Form 214. The regulation states in: * Item 11 - from the ERB, will lists all MOSs served for at least 1 year and include for each MOS the number of years and months served. For time determination, 16 days or more count as a month * Item 13 will list all awards and decorations authorized 5. Army Regulation 600-8-22 (Military Awards) states a basic marksmanship qualification badge is awarded to indicate the degree in which an individual has qualified in a prescribed record course and an appropriate bar is furnished to denote each weapon with which he/she qualified. Each bar will be attached to the basic badge that indicates the qualification last attained with the respective weapon. Basic qualification badges are of three classes: Expert, Sharpshooter, and Marksman. An award for previous marksmanship weapons qualification is revoked automatically whenever an individual, upon completion of firing a record course for which the previous award was made, has not attained the same qualification. DISCUSSION AND CONCLUSIONS: 1. With regard to item 11 of his DD Form 214: a. The evidence shows he completed training and served in duty MOS 45K from 22 August 2006 through 4 March 2012, a period of 5 years, 6 months, and 11 days. It is presumed that he held the MOS for that long, also. It appears he served in MOS 15R from 5 March 2012 through the date of his release from active duty on 25 October 2013. b. He is therefore entitled to correction of item 11 of his DD Form 214 to show he served in MOS 45K for 5 years and 6 months. 2. With regard to the Expert Marksman Qualification Badge, the evidence shows that on 8 March 2013 he earned the qualification score rating for the Expert Marksmanship Qualification Badge. By regulation, the expert badge is a higher degree than the sharpshooter. In view of his qualifying for the expert degree, his is entitled to award of the Expert Marksmanship Qualification Badge with Rifle Bar and its addition to his DD Form 214.
