THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests orders awarding him the fourth award of the Army Good Conduct Medal be removed from his Official Military Personnel File (OMPF). 2. The applicant states he has received his first and second award of the Army Good Conduct Medal, but he should not have been issued a fourth award. 3. The applicant provides: * orders for his first and second awards of the Army Good Conduct Medal * orders awarding him a fourth award of the Army Good Conduct Medal CONSIDERATION OF EVIDENCE: 1. On 1 August 2006, he enlisted in the Regular Army. 2. On 6 April 2010, Commander, Brooke Army Medical Center, Fort Sam Houston, TX issued a memorandum disqualifying the applicant for the Army Good Conduct Medal for the period from 1 April to 31 July 2010. His new Army Good Conduct Medal period was to begin on 1 August 2010. 3. Headquarters, United States Army Garrison West Point, West Point, NY Permanent Orders 307-1, dated 3 November 2011, awarded him the Army Good Conduct Medal (First Award) for the period of service 1 August 2006 to 31 July 2009. 4. Headquarters, United States Army North (Fifth Army), Military Personnel Division, Joint Base San Antonio (JBSA), Fort Sam Houston, Permanent Orders 204-906, dated 23 July 2013, awarded him the AGCM (2nd Award) for the period of service 1 August 2010 to 31 July 2013. 5. Permanent Orders 036-902, issued by the same headquarters, dated 5 February 2014, awarded him the AGCM (4th Award) for the same period of service, 1 August 2010 to 31 July 2013. 6. Army Regulation 600-8-22 (Military Awards) states the AGCM is awarded to individuals who distinguish themselves by their conduct, efficiency, and fidelity. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of active Federal military service. Although there is no automatic entitlement to the AGCM disqualification must be justified. DISCUSSION AND CONCLUSIONS: 1. The orders awarding the applicant a fourth Army Good Conduct Medal were clearly issued in error based on his not having sufficient time in service to have earned four awards of the AGCM. Therefore, it would be appropriate to revoke Permanent Orders 036-902, dated 5 February 2014. 2. Permanent Orders 036-902, dated 5 February 2014, were the result of an administrative error. This order holds no historical value in documenting the applicant's military career. Therefore, it would be appropriate to remove this order from the applicant's OMPF. The order revoking Permanent Orders 063-902, dated 5 February 2014, should not be filed in his OMPF.
