Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests his DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to show award of the Global War on Terrorism Expeditionary Medal (GWOTEM). 2. The applicant states he was deployed in both Kuwait and Jordan between September 2011 and December 2012 in support of Operation New Dawn; therefore, he qualifies for the GWOTEM. It is not reflected on his DD Form 214. 3. The applicant provides deployment orders, DD Form 214, and a webpage from the U.S. Army Human Resources Command (HRC) website. CONSIDERATION OF EVIDENCE: 1. He enlisted in the Regular Army on 29 July 2009 and after completing initial training he was awarded military occupational specialty 25S (Satellite Communications Systems Operator/Maintainer). The highest rank/grade attained while on active duty was specialist/E-4. 2. On 1 September 2011, he deployed to Kuwait in support of Operation New Dawn. He completed his tour in Kuwait on 29 August 2012 and moved to Jordan, from where he redeployed on 31 December 2012. 3. On 17 July 2013, he was honorably released from active duty under the provisions of Army Regulation 635-200 (Active Duty Enlisted Administrative Separations), chapter 4, due to completion of required active service. 4. Item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) of his DD Form 214 does not show award of the GWOTEM. Additionally, item 12f (Record of Service - Foreign Service) does not reflect his foreign service and item 18 (Remarks) does not show his deployments to Kuwait and Jordan. 5. According to the Defense Finance and Accounting Service, the applicant received Hostile Fire/Imminent Danger Pay and Combat Zone Tax Exclusion for the period 1 September 2011 through 31 December 2012 for service in Kuwait and Jordan. 6. Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. Initial award of the GWOTEM was limited to service members deployed abroad in Operations Enduring Freedom, Operation Iraqi Freedom, and Operation New Dawn in designated specific geographic areas of eligibility (AOE) that included Kuwait and Jordan. 7. Army Regulation 635-5 (Separation Documents), in effect at the time, established the standardized policy for preparing and distributing the DD Form 214. Chapter 2 contains guidance for preparation of the DD Form 214. It states that for block 12f to enter the total active duty performed outside continental United states during the period covered by the DD Form 214; for item 13 to list all awards and decorations from the Soldier's records; and for block 18, for Soldier deployed with his or her unit during their continuous period of active service, enter a statement "SERVICE IN (name of country deployed) FROM (inclusive dates for example, YYYYMMDD-YYYYMMDD)." DISCUSSION AND CONCLUSIONS: 1. He was deployed during the period 1 September 2011 through 31 December 2012 in two AOEs identified for receipt of the GWOTEM. Therefore, he qualifies for the GWOTEM and his DD Form 214 should be corrected accordingly. 2. His DD Form 214 does not show his foreign service and does not list his deployments to Kuwait and Jordan for the period 1 September 2011 through 31 December 2012. His DD Form 214 should also be corrected accordingly. 3. Based upon the foregoing, the requested relief should be granted and the additional corrections should be made.
