THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, retroactive payment of Board Certification Pay (BCP) for the period 18 August 2009 to 31 July 2012. 2. The applicant states it is an entitlement and he met the criteria to receive this pay from the day he successfully passed the exam that leads to board certification in Internal Medicine on 18 August 2009. 3. The applicant provides: * email between himself and other Army officials pertaining to his BCP * DA Form 4187 (Personnel Action), dated 20 July 2012 * The American Board of Internal Medicine Certificate, congratulatory letter, and screenshot CONSIDERATION OF EVIDENCE: 1. At the time of his application, the applicant was serving on active duty as a physician board certified in Internal Medicine. 2. In the processing of this case a staff advisory opinion was obtained from the Chief, Army Medical Department Special Pay Branch, Office of the Surgeon General (OTSG). a. OTSG stated that requests for BCP are initiated by the officer through his or her supporting human resources office. A review of the applicant's supporting documentation and available finance data indicates that office received notification and authorized payment of BCP commencing 1 August 2012 with current expiration of 31 December 2019. The applicant did not receive BCP for the period 18 August 2009 through 31 July 2012. b. The advisory official opined that the applicant was eligible to receive BCP for the period 18 August 2009 through 31 July 2012. Utilizing a Health Professions Pay Entry Date (HPPED) or finance medical special pay date (MS-Pay-Date) of 12 June 2006 for the correct pay rate level, the retroactive payment for this total period is approximately $7,600.00 prior to taxes, the exact amount to be determined by the Defense Finance and Accounting Service. 3. On 23 April 2014, a copy of the advisory opinion was forwarded to the applicant for his information and/or possible rebuttal. In an email, he stated he did not wish to submit formal comments on the advisory opinion. DISCUSSION AND CONCLUSIONS: 1. The opinion rendered by OTSG clearly states the applicant was fully qualified and eligible for the BCP during the period requested. Accordingly, he should be paid. 2. In view of the foregoing, the applicant's request should be granted.
