THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 30 November 2013 to show his place of entry into active duty and his home of record at time of entry as XXXX S____ Drive, Killeen, TX. 2. The applicant states he executed a permanent change of station to Killeen, TX, under mobilization orders the previous year and established Texas residency. He was a Texas resident when those orders terminated. He then entered active duty under sanctuary provisions the following day and remained at the Killeen address for the duration of those orders. He lived at the XXXX S____ Drive, Killeen, TX, address for over 3.5 years prior to his retirement date of 30 November 2013. 3. The applicant provides: * U.S. Army Human Resources Command (HRC) Orders A-11-220474 * HRC Orders A-11-220474A01 * DD Form 214 for the period ending 30 November 2013 CONSIDERATION OF EVIDENCE: 1. HRC Orders A-01-701942, dated 25 January 2007, ordered the applicant to a contingency operations temporary tour of active duty (CO-TTAD) at Fort Hood, TX, as a member of the U.S. Army Reserve in support of Operation Noble Eagle effective 1 February 2007 for a period of 365 days with an ending date of 31 January 2008. These orders show he entered his current tour of active duty from XXXX W____ Place, Falls Church, VA, and his home of record as XXXX W____ Place, Falls Church, VA. 2. HRC Orders A-01-701942A01, dated 4 April 2007, amended HRC Orders  A-01-701942 by changing the purpose to contingency operations for active duty for operational support (CO-ADOS) in support of Operation Noble Eagle. 3. HRC Orders A-01-902898, dated 26 January 2009, retained him on active duty at Fort Hood, TX, for a period of 358 days to participate in the Reserve Component Warriors in Transition Medical Retention Processing Program for completion of medical care and treatment with an ending date of 1 January 2010. These orders show he entered his current tour of active duty from XXXX W____ Place, Falls Church, VA, and his home of record as XXXX W____ Place, Falls Church, VA. 4. HRC Orders A-01-902898A01, dated 15 July 2009, amended HRC Orders  A-01-902898 by changing the period of active duty to 178 days with an ending date of 5 July 2009. 5. HRC Orders A-07-919910, dated 16 July 2009, ordered him to CO-ADOS at Fort Hood, TX, in support of Operation Enduring Freedom (OEF) for a period of 365 days with an ending date of 16 July 2010. These orders show he entered his current tour of active duty from XXXX W____ Place, Falls Church, VA, and his home of record as XXXX W____ Place, Falls Church, VA. 6. HRC Orders A-11-031149, dated 3 November 2010, ordered him to CO-ADOS at Fort Hood, TX, in support of the Continental United States Support Base (CSB) for a period of 365 days with an ending date of 28 November 2011. These orders show he entered his current tour of active duty from XXXX W____ Place, Apartment XXX, Falls Church, VA, and his home of record as XXXX W____ Place, Apartment XXX, Falls Church, VA. 7. HRC Orders A-10-124337, dated 27 October 2011, ordered him to CO-ADOS at Fort Hood, TX, in support of OEF-CSB for a period of 365 days with an ending date of 27 November 2012. These orders show he entered his current tour of active duty from XXXX W____ Place, Apartment XXX, Falls Church, VA, and his home of record as XXXX W____ Place, Apartment XXX, Falls Church, VA. He received a DD Form 214 ending 27 November 2012. 8. HRC Orders A-11-220474, dated 14 November 2012, ordered him to active duty at Fort Hood, TX, for a period of 550 days with an ending date of 31 May 2014 to obtain 20 years of active Federal service in accordance with Title 10, U.S. Code, section 12686, under the sanctuary program. These orders show he entered his current tour of active duty from XXXX S____ Drive, Killeen, TX, and his home of record as XXXX S____ Drive, Killeen, TX. 9. HRC Orders A-11-220474A01, dated 19 November 2012, amended HRC Orders A-11-220474A by changing the period of active duty to 368 days with an ending date of 30 November 2013. 10. On 30 November 2013, he retired from active duty. His final DD Form 214, item 7a (Place of Entry into Active Duty) shows he entered this period of active duty from Falls Church, VA. Item 7b (Home of Record at Time of Entry) shows his home of record as XXXX W____ Place, Apartment XXX, Falls Church, VA. 11. Army Regulation 635-5 (Separation Documents) at the time prescribed policy and procedural guidance relating to transition management. It consolidates the policies, principles of support, and standards of service regarding processing personnel for transition. Paragraph 5-6 provides detailed instructions for data required in each block of the DD Form 214. For Reserve Component Soldiers, the active duty orders for this period of service will list where the Soldier enters active duty (for example, home address, home station, mobilization station, Army installation, and so forth). For Reserve Component Soldiers, the active duty orders list the Soldier's home of record. Home of record is the place recorded as the home of record of the Soldier when commissioned, appointed, enlisted, or ordered to a tour of active duty. DISCUSSION AND CONCLUSIONS: 1. The applicant initially entered active duty on 1 February 2007 from XXXX W____ Place, Falls Church, VA, and his home of record was recorded as XXXX W____ Place, Falls Church, VA. He served on consecutive active duty orders until he retired on 30 November 2013. However, his orders show he entered his last period of active duty from XXXX S____ Drive, Killeen, TX, and his home of record was recorded as XXXX S____ Drive, Killeen, TX. 2. Army Regulation 635-5 provides that the active duty orders for this period of service list where the Soldier entered active duty and the Soldier's home of record. 3. Based on the foregoing evidence, item 7a and item 7b of his DD Form 214 for the period ending 30 November 2013 should be corrected to show he entered active duty from XXXX S____ Drive, Killeen, TX, and his home of record as XXXX S____ Drive, Killeen, TX.
