THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Report of Separation from the Armed Forces of the United States) to show his year of birth (YOB) as 1933 instead of 1932. 2. The applicant states his YOB is incorrect. 3. The applicant provides: * DD Form 214 * Two Honorable Discharge Certificates * Mississippi State Board of Health Certificate of Birth * Central High School Diploma * Form SSA-1099 (Social Security Benefit Statement 2009) * Form W-2 (Wage and Tax Statement 2009) CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant's military records are not available to the Board for review. A fire destroyed approximately 18 million service members’ records at the National Personnel Records Center in 1973. It is believed his records were lost or destroyed in that fire. However, there were sufficient documents remaining in a reconstructed record to conduct a fair and impartial review of this case. This case is being primarily considered using the DD Form 214 provided by the applicant. 3. The applicant was called from inactive duty and entered into active service on 16 January 1951. He was honorably discharged on 2 October 1952. Item 10 (Date of Birth) of his DD Form 214 shows his YOB as 1932. He authenticated the document with his signature. 4. The applicant provides a copy of his birth certificate which shows his YOB as 1933. 5. War Department Technical Manual 12-236 (Preparation of Separation Forms) and Army Regulation 635-5 (Separation Documents), currently in effect, prescribe the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. These regulations establish standardized policy for the preparation of the separation document. In pertinent part, they state that the separation document is a synopsis of the Soldier's most recent period of continuous active duty and provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. DISCUSSION AND CONCLUSIONS: 1. The applicant's contention that his DD Form 214 should be corrected to change his YOB from 1932 to 1933 was carefully considered. 2. The evidence of record shows his YOB appeared as 1932 on the only document in his available service personnel record throughout his period of service. 3. The Army has an interest in maintaining the accuracy of its records for historical purposes. The information in those records must reflect the conditions and circumstances that existed at the time the records were created. In the absence of compelling information to the contrary, there is no basis for changing the records in this case. 4. The fact that he provided a birth certificate which shows his YOB as 1933 is duly noted. However, this does not change the conditions and circumstances that existed at the time his service records were created. 5. In view of the foregoing, he is not entitled to the requested relief.
