Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests reconsideration of his previous request for correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show the Combat Infantryman Badge. 2. The applicant states, in effect, he is providing a new argument to support his request. 3. The applicant provides a statement, a letter, and an Army Board for Correction of Military Records (ABCMR) Record of Proceedings. CONSIDERATION OF EVIDENCE: 1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the ABCMR in Docket Number AR20110013666 on 12 January 2012. 2. As a new argument the applicant states he was stationed in Germany in 1966 and he volunteered to go to Vietnam. In order to do so, he had to change his military occupational specialty (MOS) to 11B (Light Weapons Infantryman). He was awarded the Combat Infantryman Badge while he was serving in Vietnam. There was no place to keep personal belongings so everything was left at home base and his copy of the orders for this badge was lost. 3. Having had prior active service, the applicant's record shows he enlisted in the Regular Army on 11 August 1965 and he held MOS 11D (Armor Reconnaissance Specialist) and 11B. He served in Vietnam from 28 September 1967 to 2 August 1968 while assigned to the 17th Cavalry Regiment, 196th Infantry Brigade. 4. General Orders Number 1815, dated 7 April 1968, issued by Headquarters, Americal Division, awarded him the Purple Heart for wounds received in Vietnam in connection with military operations against a hostile force on 21 March 1968. 5. He was honorably discharged on 2 August 1968. He completed 2 years, 11 months, and 22 days of creditable active service during this period of service and he had a total of 6 years and 2 months of creditable active service. 6. The DD Form 214 he was issued for this period of service does not show the Combat Infantryman Badge and his record is void of orders awarding him the Combat Infantryman Badge. 7. Item 38 (Record of Assignments) of his DA Form 20 (Enlisted Qualification Record) shows during his service in Vietnam he served in duty MOS 11D with the principal duty of assistant squad leader. 8. Item 40 (Wounds) of his DA Form 20 (Enlisted Qualification Record) shows he received a shrapnel wound to the back on 21 March 1968. 9. Review of The Adjutant General's Office Casualty Division's Vietnam casualty listing shows the applicant's name is listed as a casualty on 21 March 1968 under casualty status code "23." This casualty code refers to "hostile wounded in action, hospitalized." 10. A review of the Awards and Decorations Computer Assisted Retrieval System maintained by the Military Awards Branch of the U.S. Army Human Resources Command, which is an index of general and/or special orders issued during the Vietnam era between 1965 and 1973, failed to reveal orders for the Combat Infantryman Badge pertaining to the applicant. 11. Army Regulation 600-8-22 (Military Awards) provides that the Combat Infantryman Badge is awarded to infantry officers and to enlisted and warrant officer persons who have an infantry MOS. They must have served in active ground combat while assigned or attached to an infantry unit of brigade, regimental or smaller size. U.S. Army Vietnam Regulation 672-1 (Awards and Decorations) provided for award of the Combat Infantryman Badge to infantry personnel who were members of infantry platoons and squads in armored cavalry squadrons and regiments. Additionally, this regulation provided that during the Vietnam era the Combat Infantryman Badge was awarded only to enlisted individuals who held and served in MOS 11B, 11C, 11D, 11F, 11G, or 11H. DISCUSSION AND CONCLUSIONS: The evidence of record confirms the applicant held MOS 11D and he was assigned as an assistant squad leader in a cavalry unit and infantry brigade during his service in Vietnam. He was awarded of the Purple Heart for wounds received in action on 21 March 1968 and the Vietnam casualty roster confirms he was wounded in action by hostile forces and hospitalized for those wounds on that date. Based on this, it can be presumed that he served in active ground combat against enemy forces in Vietnam. Therefore, it would be appropriate at this time to award him the Combat Infantryman Badge and to correct his DD Form 214 to show this award.
