THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests the DA Form 1059 (Service School Academic Evaluation Report) currently filed in his Army Military Human Resource Record (AMHRR), formerly known as official military personnel file, be replaced with one that shows he "Exceeded Course Standards." 2. The applicant states: * He attended the Primary Leadership Development Course (PLDC) in 1993 and graduated in the top 20 percent of his class * He received a DA Form 1059 from the Noncommissioned Officer Academy (NCOA) that shows he "Exceeded Course Standards" * The DA Form 1059 filed in his AMHRR shows he "Achieved Course Standards" * He is unsure why the wrong DA Form 1059 is filed in his AMHRR; he has been trying to resolve this error for some time 3. The applicant provides the requested and contested DA Forms 1059. CONSIDERATION OF EVIDENCE: 1. The applicant initially served in the Army National Guard from 25 October 1989 through 3 December 1990 and he held military occupational specialty (MOS) 88M (Motor Transport Operator). 2. He enlisted in the Regular Army on 4 December 1990. He served through multiple reenlistments in a variety of stateside or overseas assignments and he attained the rank/grade of sergeant first class (SFC)/E-7. He is currently serving as a senior recruiter in MOS 79R (Recruiter). 3. He attended the resident PLDC Class 2-94, at Libby NCOA, Fort Leonard Wood, MO, during the period 16 November 1993 through 16 December 1993. 4. His AMHRR contains a DA Form 1059 (contested), dated 16 December 1993, that shows the entry "Achieved Course Standards" in item 13 (Performance Summary) and the below comments. He was rated "Superior" in "Leadership Skills" and "Contribution to Group Work." [Applicant] completed all requirements above standards. He maintained a high academic average throughout the course. [Applicant] consistently demonstrated a high degree of bearing and excellent study habits. He displayed a willingness to assist others when they were in need of assistance. [Applicant] achieved success by self-motivation and a strong sense of purpose. He contributed a positive attitude and set a good example for future leaders to follow. This attitude, along with his hard work enabled him to complete the course in the top twenty percent. [Applicant] is a dedicated, well rounded soldier, capable of accomplishing any task. With the knowledge gained here, he should prove to be an asset to his unit and the noncommissioned officer corps. This form was prepared and authenticated by Staff Sergeant (SSG) CWH, the small group leader, and reviewed and authenticated by First Sergeant (1SG) IYM, the 1SG and chief of PLDC. 5. He provides a DA Form 1059 (requested), that was prepared on the same date and authenticated by the same SSG and 1SG, and shows the exact same information except item 13 which shows the entry "Exceeded Course Standards.” 6. Army Regulation 623-1 (Academic Evaluation Reporting System), dated 30 April 1992, established policies and procedures for the Academic Evaluation Reporting System. It states the DA Form 1059 is used to report the performance of students attending service schools, NCO academies, and other schools. Paragraph 2-8 provides detailed instructions for preparing the DA Form 1059. a. Item 13 describes the performance summary. An "x" is placed beside the most appropriate entry as follows: * "Exceeded Course Standards" is used for those students whose overall course achievement is significantly above the standards of the course; this category is restricted to those students who are considered deserving by the commandant but will not exceed 20 percent of the class enrollment * "Achieved Course Standards" is used for those students who achieved the overall acceptable course standard * Comments must be in detail to justify the level of performance indicated b. Item 14 (Demonstrated Abilities) shows the level of performance by placing an "x" beside the appropriate entry as follows: * A "Superior" rating indicates the student has demonstrated an ability that is significantly above the standards * A "satisfactory" rating indicates the student has demonstrated an acceptable level of proficiency DISCUSSION AND CONCLUSIONS: 1. The applicant attended PLDC from November to December 1993. He was issued a DA Form 1059 that shows he "Achieved Course Standards." He contends that the DA Form 1059 he was given shows he "Exceeded Course Standards." 2. Although the applicant received a "superior" rating in the areas of "Leadership Skills" and "Contribution to Group Work," a clear indication he demonstrated an ability that is significantly above the standards, the entry "Exceed Course Standards" is limited to only 20 percent of class enrolment. It is unclear if the applicant was one of the "20 percent" of class enrollees who exceeded the standards. 3. The applicant has served continuously since 1990 and attained the rank/grade of SFC/E-7. There is no indication he appealed this DA Form 1059 to the NCOA that issued it. 4. Nearly 20 years has passed since this form was issued. In the absence of additional corroborating evidence from the NCOA that issued it, such as an affidavit from the course instructor, a statement from the commandant, or other form of evidence, it is impossible to determine which DA Form 1059 should be filed in his AMHRR. Regrettably, there is insufficient evidence to support his request.
