THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his proper military occupational specialty (MOS). 2. The applicant states Item 11 (Primary Specialty) of his DD Form 214 reads: * 15T10 00 POWER GENERATION EQUIPMENT REPAIR--2 YRS-5 MOS//11B1P INFANTRYMAN--3 YRS-5 MOS//NOTHING FOLLOWS 3. The applicant states Item 11 should read: * 15T10 00 UTILITY HELICOPTER REPAIRER--2 YRS-5 MOS//11B1P INFANTRYMAN--3 YRS-5 MOS//NOTHING FOLLOWS 4. The applicant provides * DD Form 214 * Memorandum, dated 13 July 2005, requesting issuance of a DD Form 215 (Correction to DD Form 214) to correct Item 11 * Orders 064-00241, U.S. Army Transportation Center and Fort Eustis, Fort Eustis, VA, dated 5 March 2003, awarding him MOS 67T1O (UH-1 Blackhawk Helicopter Repairer) * Orders 65-04, U.S. Army Transportation Center and Fort Eustis, Fort Eustis, VA, dated 5 March 2003, awarding him the Aviation Badge-Basic CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 28 July 1999. He was trained in MOS 67T1O (UH-60 Blackhawk Helicopter Repairer). He was honorably separated on 12 September 2005. Item 11 of his DD Form 214 shows his MOS entry as: * 15T10 00 POWER GENERATION EQUIPMENT REPAIR--2 YRS-5 MOS//11B1P INFANTRYMAN--3 YRS-5 MOS//NOTHING FOLLOWS 3. In 2004, MOS 67T1O (UH-60 Blackhawk Helicopter Repairer ) was converted to MOS 15T1O (Utility Helicopter Repairer). 4. The correct MOS number for a power generation equipment repairer is 52D, which was later converted to 91D. DISCUSSION AND CONCLUSIONS: The applicant was school-trained in MOS 67T. This was later converted to MOS 15T. Both MOSs were "utility helicopter repairers." His DD Form 214 should be corrected.
