THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to change his discharge from an under other than honorable conditions discharge to honorable or a medical discharge. 2. The applicant states that: * he was mentally ill when he was in the Army and still is * he has a schizophrenic and schizoaffective disorder with anxiety and depression * he did not know what was wrong with him at the time and he would not admit he had a mental illness, he still hides it as much as possible * while he was in the Army, he suffered from anxiety, depression, and he heard voices * he was absent without leave (AWOL) to get back home where he did not feel this way * he worked hard in the Army and the military police, but because of his illness, he could not do it * he wanted to with all his heart, but he was afraid he would hurt someone or himself * if not for his illness, he would have made a good military policeman 3. The applicant provides his DD Form 214. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant's records show he enlisted in the Regular Army for a 3-year term on 18 September 1979. He completed training and was awarded military occupational specialty (MOS) 95B (Military Policeman). He was assigned to the 241st Military Police Company, Fort Monmouth, NJ. 3. On 11 January 1980, he accepted nonjudicial punishment (NJP) under the provisions of Article 15, Uniform Code of Military Justice (UCMJ), for absenting himself from his appointed place of duty in violation of a lawful order on 7 January 1980. 4. On 12 February 1980, he departed his unit in an AWOL status and was subsequently dropped from the Army rolls on 12 March 1980. He ultimately surrendered to military authorities on 18 March 1980 in Augusta, ME. 5. On 1 April 1980, court-martial charges were preferred against him for being AWOL from 12 February 1980 until his return to military control on 18 March 1980. 6. On 2 April 1980, he consulted with legal counsel and was advised of the basis for the contemplated trial by court-martial, the maximum permissible punishment authorized under the UCMJ, the possible effects of an under other than honorable conditions discharge, and of the procedures and rights that were available to him. Subsequent to receiving this legal counsel, he voluntarily requested discharge under the provisions of Army Regulation 635-200 (Personnel Separations – Enlisted Personnel), chapter 10, for the good of the service in lieu of trial by court-martial. 7. In his request for discharge, he indicated he understood that by requesting discharge he was admitting guilt to the charge against him or to a lesser-included offense that also authorized the imposition of a bad conduct or dishonorable discharge. He further acknowledged he understood that if his discharge request were approved, he could be deprived of many or all Army benefits, he could be ineligible for many or all benefits administered by the Veterans Administration, and he could be deprived of his rights and benefits as a veteran under both Federal and State laws. 8. On 7 May 1980, the separation authority approved his request for discharge and directed the issuance of an Under Other Than Honorable Conditions Discharge Certificate. On 4 June 1980, he was discharged accordingly. His DD Form 214 confirms he completed 7 months and 11 days of net active service during this period of active duty and he had 35 days of lost time. 9. His available records do not indicate he suffered an injury or an illness that would have warranted his referral to the Physical Disability Evaluation System (PDES). 10. There is no indication he applied to the Army Discharge Review Board for an upgrade of his discharge within that board's 15-year statute of limitation. 11. Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 10 provides that a member who has committed an offense or offenses for which the authorized punishment includes a punitive discharge may submit a request for discharge for the good of the service in lieu of trial by court-martial. The request may be submitted at any time after charges have been preferred and must include the individual's admission of guilt. Although an honorable or general discharge is authorized, a discharge under other than honorable conditions is normally considered appropriate. 12. Army Regulation 635-200, paragraph 3-7a, provides that an honorable discharge is a separation with honor and entitles the recipient to benefits provided by law. The honorable characterization is appropriate when the quality of the member's service generally has met the standards of acceptable conduct and performance of duty for Army personnel or is otherwise so meritorious that any other characterization would be clearly inappropriate. 13. Army Regulation 635-200, paragraph 3-7b, provides that a general discharge is a separation from the Army under honorable conditions. When authorized, it is issued to a Soldier whose military record is satisfactory but not sufficiently meritorious to warrant an honorable discharge. A characterization of under honorable conditions may be issued only when the reason for the Soldier's separation specifically allows such characterization. 14. Army Regulation 635-40 (Physical Evaluation for Retention, Retirement, or Separation) establishes the PDES and sets forth policies, responsibilities, and procedures that apply in determining whether a Soldier is unfit because of physical disability to reasonably perform the duties of his or her office, grade, rank, or rating. It provides for medical evaluation boards (MEB's), which are convened to document a Soldier's medical status and duty limitations insofar as duty is affected by the Soldier's status. A decision is made as to the Soldier's medical qualifications for retention based on the criteria in chapter 3 of Army Regulation 40-501 (Standards of Medical Fitness). 15. Army Regulation 635-40 provides guidance on processing through the PDES, which includes the convening of an MEB to document a Soldier's medical status and duty limitations insofar as duty is affected by the Soldier's status. If the MEB determines a Soldier does not meet retention standards, the case will be referred to a physical evaluation board (PEB). The PEB evaluates all cases of physical disability equitably for the Soldier and the Army. It also investigates the nature, cause, degree of severity, and probable permanency of the disability of Soldiers whose cases are referred to the board. It evaluates the physical condition of the Soldier against the physical requirements of the Soldier's particular office, grade, rank, or rating. Finally, it makes findings and recommendations required by law to establish the eligibility of a Soldier to be separated or retired because of physical disability. 16. Army Regulation 635-40 states the mere presence of impairment does not, of itself, justify a finding of unfitness because of physical disability. In each case, it is necessary to compare the nature and degree of physical disability present with the requirements of the duties the member reasonably may be expected to perform because of his or her office, rank, grade, or rating. The Army must find that a service member is physically unfit to reasonably perform his or her duties and assign an appropriate disability rating before that service member can be medically separated or retired. DISCUSSION AND CONCLUSIONS: 1. The applicant's request for correction of his DD Form 214 to change the character of his discharge from under other than honorable conditions to honorable or to a medical discharge was carefully considered; however, there is insufficient evidence to support his request. 2. His records indicate he was charged with the commission of an offense punishable under the UCMJ with a punitive discharge. Discharges under the provisions of Army Regulation 635-200, chapter 10, are voluntary requests for discharge in lieu of trial by court-martial. Therefore, it is presumed in this case that the applicant voluntarily requested discharge from the Army in lieu of trial by court-martial. 3. The applicant's discharge proceedings were conducted in accordance with law and regulations applicable at the time. The characterization of service is commensurate with the applicant's overall record of military service. 4. With respect to a medical discharge, there is no evidence in the available records and he failed to submit any evidence that shows he suffered from a medical condition that limited his ability to perform in his grade and MOS or that would have warranted entry into the PDES. 5. There is no evidence in the available records and he failed to submit any evidence that shows he was considered by an MEB. Without an MEB, there would have been no basis for referring him to a PEB. Without a PEB, the applicant could not have been issued a medical discharge for physical disability. 6. In view of the foregoing evidence, there is insufficient evidence to grant him a medical discharge.
