THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests he be credited with additional retirement points for his service in the Army National Guard in 2002. 2. The applicant states, in effect, his U.S. Army Reserve (USAR) Personnel Command Chronological Statement of Retirement Points does not show any retirement points for his time in the California Army National Guard while assigned to Headquarters and Headquarters Company, 2nd Battalion, 185th Armor in 2002. 3. The applicant provides: * Undated tax form * Undated letter from the California Army National Guard * DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 30 September 2010 CONSIDERATION OF EVIDENCE: 1. He enlisted in the Virginia Army National Guard on 18 August 1999 for a period of 8 years. 2. His USAR Personnel Command Chronological Statement of Retirement Points, dated 8 February 2011, shows his National Guard and Reserve service. This statement shows he had a break in service from 22 June 2001 through 9 January 2003. 3. His NGB [National Guard Bureau] Form 22 (Report of Separation and Record of Service) shows he enlisted in the Maryland Army National Guard on 10 January 2003. His NGB Form 22 also shows he had 1 year, 10 months, and 4 days of prior Reserve component service. 4. He is currently serving in a USAR troop program unit in the rank of staff sergeant. 5. In support of his claim, he provided an undated tax form which shows he earned $2,966.98 from the Defense Finance and Accounting Service in Indianapolis, IN. He also provided an undated notification letter from the California Army National Guard sent to his employer which states he was ordered to perform military duty for annual training (active duty) for the period 13 June 2002 to 21 June 2002. DISCUSSION AND CONCLUSIONS: 1. He contends he did not receive any retirement points for his time in the California Army National Guard in 2002. 2. His Retirement Points History Statement shows he had a break in service from 22 June 2001 to 9 January 2003. His NGB Form 22 shows he enlisted in the Maryland Army National Guard on 10 January 2003 with 1 year, 10 months, and 4 days of prior Reserve service (apparently from 18 August 1999 to 21 June 2001). 3. He did not provide any evidence that shows he earned any inactive or active duty retirement points in 2002. The documentation provided by the applicant does not show he actually performed the annual training during the period 13 June 2002 to 21 June 2002. Therefore, there is an insufficient basis for granting his request for additional retirement points. 4. However, the documentation the applicant provided is an indication that he performed additional active duty and/or inactive duty drills. He should contact his prior Army National Guard units and/or the Defense Finance and Accounting Service to obtain the necessary supporting documentation (such as DA Forms 1380 (Record of Individual Performance of Reserve Duty Training) or leave and earnings statements) to support his request for additional retirement points. He should then work with his unit administrator to have the U.S. Army Human Resources Command update his Statement of Retirement Points.
