Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his true military occupational specialty (MOS). 2. The applicant states he was a medic, not a dental technician as shown on his DD Form 214. 3. The applicant provides no other documentation. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 4 November 1969 for a period of 3 years. His enlistment documents show he enlisted for the airborne enlistment option and Army Career Group 91 (Medical Care and Treatment). 3. Item 23a (Specialty Number & Title) of his DD Form 214 shows the entry "AWD [Award]: 16 SEP 70, 91E2O MEDIC" and item 23b (Related Civilian Occupation), shows the entry "DENTAL ASST 079.378." 6. The Dictionary of Occupational Titles, commonly known as the DOT, was the creation of the U.S. Employment Service, which used its thousands of occupational definitions to match job seekers to jobs from 1939 to the late 1990s. Army MOS 91B corresponded to DOT entry "MEDICAL ASST 079.362." DISCUSSION AND CONCLUSIONS: 1. The applicant's contention that he was a 91B Medic instead of a 91E2O Medic with a related civilian occupation and DOT number of Dental Assistant 079.378 was carefully considered and found to have merit. 2. Records show the applicant was trained in and awarded MOS 91B and he served as an ambulance driver and a medic. Therefore, items 23a and b of his DD Form 214 should be corrected accordingly.
