THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests that she be paid the Foreign Language Proficiency Bonus (FLPB) that she was entitled to receive while on active duty but was denied. 2. The applicant states she turned in the results of her Defense Language Proficiency Test (DLPT) to her battalion S-1 the same week she took the test and after waiting 2 weeks she was told her language was not on the list to be paid the FLPB. She further states she has researched the information and found that her language was on the list to be paid the FLPB and she desires to be paid at this time. 3. The applicant provides a copy of her DA Form 330 (Language Proficiency Questionaire). CONSIDERATION OF EVIDENCE: 1. The applicant was born in Canton, China and enlisted in the Regular Army in San Francisco, California as an immigrant alien on 16 November 2004 for a period of 4 years and training as an automated logistics specialist. 2. She completed her training and was assigned to Fort Campbell, Kentucky. She was advanced to the pay grade of E-4 on 1 March 2007. 3. On 31 January 2008, she was issued a DA Form 330 indicating that she had tested in Chinese-Cantonese. 4. On 15 November 2008, the applicant was honorably released from active duty (REFRAD) due to completion of required service. She had served 4 years of total active service and she was transferred to the United States Army Reserve Control Group (Reinforcement) to complete her statutory service obligation. 5. In the processing of this case officials at the Department of the Army G-1 were contacted to ascertain the applicant’s qualification for the FLPB. Officials at that office indicate the applicant qualified for the FLPB in Chinese-Cantonese with a 2+ rating and was eligible to receive FLPB of $300.00 per month from 31 January 2008. Additionally, she qualified for Chinese-Mandarin after the third attempt with a 2+ rating effective 1 February 2008, which qualified for a FLPB of $200.00 per month; however, she was only authorized to be paid for one dialect. 6. Army Regulation 11-6 (Army Foreign Language Program) provides, in pertinent part, that a Soldier is eligible to receive the FLPB if they are certified proficient within the past 12 months in a foreign language which the Army has a critical need as determined by the Assistant Secretary of the Army (Manpower and Reserve Affairs). Chinese (four dialects) are listed on that list and the applicant’s dialects are two of the four listed. DISCUSSION AND CONCLUSIONS: 1. The applicant’s contentions have been noted and appear to have merit. On 31 January 2008, she tested and received a 2+2+ rating in Chinese–Cantonese and was entitled to receive FLPB of $300.00 per month. 2. Therefore, it would be appropriate at this time to pay her the FLPB from 31 January 2008 until she was honorably REFRAD on 15 November 2008, at the rate of $300.00 per month.
