THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 7 August 1998 to reflect the correct dates of his active duty service and military education. 2. The applicant states the DD Form 214 does not accurately reflect the full amount of time he was on active duty during the period 26 June 1997 to 7 August 1998 and does not list the course he completed during this period of active duty service. 3. The applicant provides a DD Form 214 for the period ending 7 August 1998, active duty orders with amendment, course completion diploma, training completion letter, and a Leave and Earnings Statement. CONSIDERATION OF EVIDENCE: 1. At the time of this application, the applicant was serving in the U.S. Army Reserve (USAR) in the rank of staff sergeant/E-6. 2. State of Alabama Military Department Orders Number 172-023, dated 21 June 1997, ordered him to active duty for training (ADT) for the period 26 June 1997 to 22 January 1998 for the purpose of attending phase 1 of the Medical Laboratory Technician (MLT) Initial Entry Training (IET) Course. 3. State of Alabama Military Department Orders Number 023-160, dated 23 January 1998, amended orders number 172-023 to show his period of ADT as 26 June 1997 to 12 August 1998 for the purpose of attending phases 1 and 2 of the MLT IET Course. 4. Item 35 (Record of Assignments) of his DA Form 2-1 (Personnel Qualification Records) shows he was in a student status from 27 June 1997 through 7 August 1998. 5. He provides a U.S. Army Academy of Health Sciences Diploma that shows he attended the MLT Course from 30 June 1997 to 7 August 1998. 6. Item 12a (Date Entered Active Duty this Period) of his DD Form 214 for the period ending 7 August 1998 shows he entered active duty on 9 February 1998. Item 12b (Separation Date this Period) shows he was released from active duty on 7 August 1998. Item 12c (Net Active Service this Period) shows he served 5 months and 29 days of active duty service during this period of service. Item 14 (Military Education) is blank. 7. Army Regulation 635-5 (Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. a. It establishes standardized policy for the preparation of the DD Form 214. b. It states the DD Form 214 is a summary of the Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active service at the time of release from active duty, retirement, or discharge. c. It provides that item 14 will list in–service training courses to include the title, number of weeks, and year successfully completed. This information is to assist the member after separation in job placement and counseling. DISCUSSION AND CONCLUSIONS: 1. The applicant's contention that his DD Form 214 for the period ending 7 August 1998 should be corrected to reflect he served the correct dates of his active duty service and military education has been carefully reviewed. 2. Orders show he was ordered to ADT from 26 June 1997 to 12 August 1998. His DA Form 2-1 shows he was in a student status from 27 June 1997 through 7 August 1998, and a U.S. Army Academy of Health Sciences Diploma shows he attended the MLT Course from 30 June 1997 to 7 August 1998. Therefore, it appears an error was made in the preparation of his DD Form 214 in that it shows he entered active duty on 9 February 1998. Item 12a of his DD Form 214 should be corrected to reflect he entered active duty on 26 June 1997 and item 12c should be corrected to show he completed 1 year, 1 month, and 13 days of net active service this period. 3. Item 14 of his DD Form 214 should also be corrected to show the entry "Medical Laboratory Technician, 57 Weeks, 1998."
