Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests the issuance of a DD Form 214 (Certificate of Release or Discharge from Active Duty) for completion of basic combat and advanced individual training (BCT/AIT). 2. The applicant states she was not given a DD Form 214 after completing AIT and she does not know why a DD Form 214 is not posted to her Official Military Personnel File (OMPF). 3. The applicant did not provide any additional documentary evidence in support of her request. CONSIDERATION OF EVIDENCE: 1. The applicant's records show she enlisted in the U.S. Army Reserve (USAR) Delayed Entry Program (DEP) on 9 June 2006. A copy of her DD Form 4 (Enlistment/Reenlistment Document - Armed Forces of the United States) for this enlistment is not available for review with this case. 2. On 28 June 2006, U.S. Army Human Resources Command, St. Louis, MO, published Orders C-06-618834, releasing her voluntarily from the USAR DEP and assigning her to the 88th Regional Readiness Command (RRC), Fort Snelling, MN, effective 27 June 2006. 3. On or about 27 June 2006, she was ordered to active duty for training (ADT) and subsequently completed BCT at Fort Jackson, SC, from on or about 3 July 2006 to on or about 8 September 2006. She then completed AIT at Aberdeen Proving Ground, MD, from on or about 8 September 2006 to on or about 15 December 2006 and she was awarded military occupational specialty 52D (Power-Generation Equipment Repairer). 4. She was released from ADT to the control of her USAR unit on or about 15 December 2006. Her record is void of a separation order or a DD Form 214 for this period of service. 5. On 20 December 2006, Headquarters, 88th RRC, Fort Snelling, published orders assigning her to the 753rd Quartermaster Company, Green Bay, WI. 6. On 22 January 2007, she was honorably discharged from the USAR and on 23 January 2007, she executed a 3-year enlistment in the Regular Army. She was subsequently assigned to the 62nd Supply and Services Company, Fort Hood, TX. 7. She was honorably released from active duty on 22 January 2010. The DD Form 214 she was issued shows the following entries: a. Item 12c (Net Active Service This Period) - "0003 00 00" [3 years] and b. Item 12d (Total Prior Active Service) - "0000 05 19" [5 months and 19 days] 8. Her ARPC Form 249-E (Chronological Statement of Retirement Points) shows she served on active duty from 27 June 2006 to 15 December 2006. 9. Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214. The purpose of the separation document is to provide the individual with documentary evidence of his or her military service. It is important that information entered on the form should be complete and accurate. The DD Form 214 is a summary of a Soldier’s most recent period of continuous active duty. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge. The DD Form 214 will be prepared for Reserve Component Soldiers completing 90 days or more of continuous ADT. Chapter 2 of Army Regulation 635-5 contains guidance on the preparation of the DD Form 214. Item 12 shows the Record of Service. Extreme care is used when completing this block since post-service benefits, final pay, retirement credit, and so forth are based on this information. A breakdown of entries in Item 12 is as follows: a. Item 12a (Date Entered Active Duty (AD) This Period) shows the beginning date of the continuous period of active duty for issuance of this DD Form 214, for which a DD Form 214 was not previously issued. b. Item 12b (Separation Date This Period) shows the Soldier’s transition date. This date may not be the contractual date if Soldier is separated early, voluntarily extends, or is extended for make-up of lost time, or retained on active duty for the convenience of the Government. c. Item 12c shows the amount of service this period, computed by subtracting item 12a from 12b, less lost time. d. Item 12d, obtained from previously issued DD Forms 214, shows the total amount of prior active military service less lost time, if any. If not applicable, enter “00 00 00.” 10. Paragraph 2-7 of Army Regulation 635-5 states that a DD Form 214 is not issued to replace record copies or DD Forms 214 lost by Soldiers. If no DD Form 214 is available, issue a statement of service or transcript of military record. DISCUSSION AND CONCLUSIONS: 1. The evidence of record shows the applicant entered ADT on or around 27 June 2006 and was released from ADT on or around 15 December 2006. She completed 5 months and 19 days of creditable active service. It is unknown if a DD Form 214 was issued for this period of active service. 2. The evidence of record also shows she enlisted in the Regular Army on 23 January 2007 and she was honorably released from active duty on 22 January 2010. Her DD Form 214 captured her 3 years of active service this period as well as her prior period of 5 months and 19 days of active service. 3. By regulation, when a record DD Form 214 is lost by Soldiers a DD Form 214 will not be issued to replace a record copy. However, if no DD Form 214 is available, issue a statement of service or transcript of military record. The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by preparing and issuing the applicant a statement of service for her period of ADT service from 27 June 2006 through 15 December 2006. 2. The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief.
