Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his records to show award of the Armed Forces Expeditionary Medal (AFEM) for his service in Exercise Intrinsic Action. 2. The applicant states military personnel at a mobilization site noted his records show he may be eligible for the AFEM. 3. The applicant provides the following: * a certificate of achievement for his service during Intrinsic Action 97-02 * two memoranda verifying his deployment to Kuwait in 1997 * an internet printout of an unofficial list of eligible AFEM operations CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army on 27 February 1996. He was trained in and awarded military occupational specialty (MOS) 11M (Fighting Vehicle Infantryman). He was honorably released from active duty on 14 May 2002 and transferred to the U.S. Army Reserve (USAR) Control Group (Reinforcement) to complete his Reserve obligation. He subsequently enlisted in the New Jersey Army National Guard (NJARNG). 2. A DA Form 2-1 (Personnel Qualification Record) shows he was assigned to Headquarters and Headquarters Company, 2d Battalion, 5th Cavalry, during the period 15 July 1996 through 10 December 1997. 3. The applicant's Official Military Personnel File (OMPF) is void of documentation showing he served in Kuwait; however, the certificate and memoranda provided by the applicant from his former commanders confirm his service in Kuwait during Exercise Intrinsic Action 97-02. 4. Army Regulation 600-8-22 (Military Awards) states the AFEM is authorized for participants in military operations within a specific geographic area during a specified time period. An individual, who was not engaged in actual combat or equally hazardous activity, must have participated in operations or in direct support of operations for 30 consecutive or 60 nonconsecutive days. Tables 2-2 through 2-4 of this regulation list military operations designated for award of the AFEM. Exercise Intrinsic Action is not among the operations listed. DISCUSSION AND CONCLUSIONS: 1. The applicant's request to correct his records to show award of the AFEM was carefully considered but is not supported by the evidence. 2. Army Regulation 600-8-22 does not list Exercise Intrinsic Action as a designated operation for award of the AFEM. Therefore, the applicant is not entitled to have his record corrected to show this award.
