IN THE CASE OF: BOARD DATE: 3 September 2009 DOCKET NUMBER: AR20090013738 THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, removal of U.S. Central Command, MacDill Air Force Base, FL, Permanent Orders 340-002, dated 5 December 2008, from his Official Military Personnel File (OMPF). 2. The applicant states, in effect, that Permanent Orders 340-002 show the Good Conduct Medal (7th Award) and it should show the Good Conduct Medal (6th Award). He states that Permanent Orders 169-001 revoked Permanent Orders 340-002 and Permanent Orders 169-002, issued by the same headquarters, dated 18 June 2009, are the correct orders. All three orders were sent to the Commander, U.S. Army Enlisted Records and Evaluation Center (USAEREC). 3. The applicant provides Permanent Orders 169-002 awarding him the Good Conduct Medal (6th Award); Permanent Orders 340-002 awarding him the Good Conduct Medal (7th Award); and Permanent Orders 169-001, revoking Permanent Orders 340-002 in support of his application. CONSIDERATION OF EVIDENCE: 1. The applicant is currently serving on active duty in the rank/grade of sergeant first class (SFC)/E-7. 2. Permanent Orders 340-002 awarded the applicant the Good Conduct Medal (7th Award) for the period 27 September 2005 to 26 September 2008. 3. Permanent Orders 169-001 revoked Permanent Orders 340-002. These orders are not filed in his OMPF. 4. Permanent Orders 169-002 correctly awarded the applicant the Good Conduct Medal (6th Award) for the period 27 September 2005 to 26 September 2008. 5. The applicant’s OMPF contains a copy of Permanent Orders 340-002 awarding him the Good Conduct Medal (7th Award) and Permanent Orders 169-002 awarding him the Good Conduct Medal (6th Award). DISCUSSION AND CONCLUSIONS: 1. The evidence of record shows the applicant was awarded the Good Conduct Medal (7th Award) by Permanent Orders 340-002, dated 5 December 2008, for the period 27 September 2005 to 26 September 2008. These orders were revoked by Permanent Orders 169-001, dated 18 June 2009. 2. Permanent Orders 169-002 were published on 18 June 2009 which correctly awarded the applicant the Good Conduct Medal (6th Award) for the period 27 September 2005 to 26 September 2008. 3. There is a viable reason for removing Permanent Orders 340-002, dated 5 December 2008, from the applicant's OMPF. These orders offer no relevant information regarding the applicant's service, conduct, or duty performance. Moreover, removing this erroneous order would eliminate the potential for confusion to officials authorized to review the performance section of the applicant's OMPF. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by removing Permanent Orders 340-002, dated 5 December 2008 from the applicant's OMPF. __________X____________ CHAIRPERSON I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case.
