IN THE CASE OF: BOARD DATE: 17 February 2010 DOCKET NUMBER: AR20090011519 THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests that his 25 January 2008 DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to show the date he separated from active duty as 25 January 2009. 2. The applicant states that his separation orders show the correct date of his separation. 3. The applicant provides a copy of his separation orders. CONSIDERATION OF EVIDENCE: 1. The applicant's records show that he enlisted in the Regular Army on 6 July 2005. 2. Installation Management Command-Europe Orders 242-04, dated 29 August 2008, released the applicant from active duty effective on 25 January 2009. 3. Item 12a (Date Entered Active Duty This Period) of the applicant's DD Form 214 shows 6 July 2005 and item 12b (Separation Date This Period) shows 25 January 2008. Item 12c (Net Active Service This Period) shows 3 years, 6 months, and 20 days. 4. Army Regulation 635-5 (Personnel Separations) establishes standardized procedures for preparation and distribution of the DD Form 214. The regulation states, in pertinent part, to enter in item 12b the Soldier's transition date. In item 12c enter the amount of service this period computed by subtracting item 12a from item 12b. DISCUSSION AND CONCLUSIONS: It is apparent that an administrative error occurred in the preparation of the applicant's DD Form 214. The applicant's separation orders are dated 7 months after the separation date shown on his DD Form 214 and the dates shown in item 12a and item 12b of his DD Form 214 do not equal the amount of service shown in item 12c (3 years, 6 months, and 20 days). Therefore, it appears that the applicant's separation year was inadvertently recorded as 2008 instead of 2009. In view of these facts, the applicant is entitled to correction of his DD Form 214. BOARD VOTE: ____X___ ____X___ ___X____ GRANT FULL RELIEF ________ ________ ________ GRANT PARTIAL RELIEF ________ ________ ________ GRANT FORMAL HEARING ________ ________ ________ DENY APPLICATION BOARD DETERMINATION/RECOMMENDATION: The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing 25 January 2009 in item 12b of his DD Form 214. _____________X___________ CHAIRPERSON I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case.
