IN THE CASE OF: BOARD DATE: 9 SEPTEMBER 2009 DOCKET NUMBER: AR20090006317 THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his correct dates of service in Iraq. 2. The applicant states that he served in Iraq from 3 January 2007 to 15 March 2008. His DD Form 214 shows an incorrect ending date of 2007. 3. The applicant provides no documentation in support of his application. CONSIDERATION OF EVIDENCE: 1. On 14 September 2004, the applicant enlisted in the Regular Army. He completed his initial training to include the basic airborne course and was awarded military occupational specialty 11C2P (Indirect Fire Infantryman with parachutist qualification). 2. The applicant's Enlisted Record Brief shows that he served in Iraq from 3 October 2005 to 2 February 2006 and from 3 January 2007 to 15 March 2008. This overseas service totaled 1 year, 6 months, and 13 days. 3. On 13 September 2008, the applicant was released from active duty and transferred to the United States Army Reserve Control Group (Reinforcement). He had attained the rank of sergeant, pay grade E-5, and had completed 4 years of creditable active duty service. 4. Item 12 (Record of Service) of the applicant's DD Form 214 shows that he served overseas for a period of 1 year, 6 months, and 13 days. Item 18 (Remarks) of this same form reports, in part, that he served in Iraq from "20070103-20070315." 5. Army Regulation 635-5 (Separation Documents) provides detailed instructions for completing separation documents, including the DD Form 214. It provides, in pertinent part, for an entry in item 12f of the total amount of foreign service completed during the current period of active duty. It further provides that item 18 will contain the following entry for Regular Army Soldiers: "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD-YYYYMMDD)." DISCUSSION AND CONCLUSIONS: 1. The applicant contends that the service dates for his duty in Iraq are incorrect on his DD Form 214 and should be corrected. 2. The evidence shows that the applicant's DD Form 214 contains an incorrect ending date for his second tour of duty in Iraq. 3. In view of the above, the applicant's request should be granted. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: a. deleting from item 18 of his DD Form 214 the entry: "SERVICE IN IRAQ 20070103-20070315" and b. adding to item 18 of his DD Form 214 the entry: "SERVICE IN IRAQ 20070103-20080315." _________XXX________________ CHAIRPERSON I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case.
