THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show that he was awarded the Combat Infantryman Badge. 2. The applicant states that he was awarded the Combat Infantryman Badge. 3. The applicant provides no additional documentation in support of his application. CONSIDERATION OF EVIDENCE: 1. On 15 March 2002, the applicant enlisted in the United States Army Reserve (USAR) in Mechanicsburg, Pennsylvania, in the pay grade of E-1 under the Delayed Entry Program. 2. The applicant enlisted in the Regular Army for 3 years on 22 May 2002, successfully completed his training, and was awarded an armor crewman military occupational specialty (MOS). 3. On 19 August 2004, the applicant's period of enlistment was extended to 3 years and 8 months. 4. The available records show that after completing 3 years, 11 months, and 9 days of net active service this period, the applicant was honorably released from active duty (REFRAD) on 30 April 2006 under the provisions of Army Regulation 635-200 (Personnel Separations), chapter 4, upon completion of his required active service. He was transferred to the USAR Control Group (Reinforcement). 5. The DD Form 214 that he was furnished at the time of his REFRAD shows that he was awarded the Army Commendation Medal (Second Award), the U.S. Army/U.S. Air Force Presidential Unit Citation, the National Defense Service Medal, the Iraq Campaign Medal, the Global War on Terrorism Expeditionary Medal, the Global War on Terrorism Service Medal, and the Army Service Ribbon. 6. A review of the available records fails to show that the applicant was ever awarded the Combat Infantryman Badge. 7. Army Regulation 600-8-22 (Military Awards) provides, in pertinent part, that the Combat Infantryman Badge is awarded to infantry officers and to enlisted and warrant officer personnel who have an infantry MOS. They must have served in active ground combat while assigned or attached to an infantry unit of brigade, regimental, or smaller size. DISCUSSION AND CONCLUSIONS: 1. The applicant contends that his DD Form 214 should be corrected to show that he was awarded the Combat Infantryman Badge. 2. His contentions have been noted. However, there is no evidence in the available record, nor has the applicant submitted any evidence, to show that he was ever awarded the Combat Infantryman Badge. 3. In accordance with the applicable regulation, the Combat Infantryman Badge is awarded to infantry officers and to enlisted and warrant officer personnel who have an infantry MOS. The applicant's records show that he was awarded an armor crewman MOS. Therefore, it appears that the Combat Infantryman Badge was properly not included on his DD Form 214. 4. In order to justify correction of a military record the applicant must show or it must otherwise satisfactorily appear, that the record is in error or unjust. The applicant has failed to submit evidence that would satisfy this requirement. 5. In view of the foregoing, there is no basis for granting the applicant's request.
