IN THE CASE OF: BOARD DATE: 5 MARCH 2009 DOCKET NUMBER: AR20080018533 THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, that the entries in item 18 (Remarks) on his 2008 DD Form 214 (Certificate of Release or Discharge from Active Duty) showing he served in Afghanistan between 19 February 2004 and 20 April 2004 and in Iraq from 20 January 2007 to 12 April 2008 be reversed. 2. The applicant states it appears his service in Iraq and Afghanistan were switched. He states he was in Iraq in 2004 and Afghanistan in 2007, but his DD Form 214 has them switched. 3. The applicant provides a copy of his 2008 DD Form 214, a copy of a 24 December 2003 command deployment order for Operation Iraqi Freedom (OIF), and a copy of a 27 October 2006 TCS (temporary change of station) group travel and transportation order for Operation Enduring Freedom (OEF). CONSIDERATION OF EVIDENCE: 1. Records available to the Board show the applicant enlisted in the Regular Army and entered active duty on 3 April 2002. 2. The 24 December 2003 memorandum, provided by the applicant, notes that “the attached Soldiers are deploying to Iraq in Support of Operation Iraqi Freedom.” The applicant’s name was among the list of Soldiers attached to the deployment memorandum. 3. The 27 October 2006 TCS order provided by the applicant was issued by the 82nd Airborne Division and notes the 4th Brigade Combat Team, of which the applicant was a member, was deploying in support of OEF on or about 12 February 2007. The applicant’s OMPF (Official Military Personnel File) also contains an evaluation report for the period 1 November 2006 through 31 October 2007 which references the applicant’s deployment in support of OEF. 4. On 10 August 2008 the applicant was released from active duty at the completion of his initial enlistment contract. Item 18 on his DD Form 214 reflects “SERVICE IN AFGHANISTAN 20040219-20040220//SERVICE IN IRAQ 20050901-20060130//SERVICE IN IRAQ 20070120-20080412//SERVICE IN AFGHANISTAN 20030110-20030827.” 5. Army Regulation 635-5 (Separation Documents) prescribes the policies and procedures regarding separation documents. In pertinent part, the regulation specifies that for active duty Soldiers who deployed with their units during their period of active service, the entry “SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (Inclusive dates for example, YYYYMMDD-YYYYMMDD)” will be entered in Item 18 of the DD Form 214. DISCUSSION AND CONCLUSIONS: It appears the entries in Item 18 on the applicant’s 2008 DD Form 214, which reflect the applicant served in Afghanistan between 19 February 2004 and 20 April 2004 and in Iraq between 20 January 2007 and 12 April 2008, were entered incorrectly by reversing the locations of the deployments. Evidence provided by the applicant supports his contention that he was actually deployed to Iraq in 2004 and Afghanistan in 2007. As such it would be appropriate, and in the interest of justice, to correct the entries accordingly. BOARD VOTE: ____X____ ____X____ ____X____ GRANT FULL RELIEF ________ ________ ________ GRANT PARTIAL RELIEF ________ ________ ________ GRANT FORMAL HEARING ________ ________ ________ DENY APPLICATION BOARD DETERMINATION/RECOMMENDATION: The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: a. deleting from Item 18 of the applicant's 2008 DD Form 214 the entries “SERVICE IN AFGHANISTAN 20040219-20040420//SERVICE IN IRAQ 20050901-20060130//SERVICE IN IRAQ 20070120-20080412//SERVICE IN AFGHANISTAN 20030110-20030827”; and b. adding to Item 18 of the applicant's 2008 DD Form 214 the entries “SERVICE IN AFGHANISTAN FROM 20030110-20030827//SERVICE IN IRAQ FROM 20040219-20040420//SERVICE IN IRAQ FROM 20050901-20060130// SERVICE IN AFGHANISTAN FROM 20070120-20080412.” __________XXX____________ CHAIRPERSON I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case.
