THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, correction of item 7b (Home of Record) on his DD Form 214 (Certificate of Release or Discharge from Active Duty) to reflect his Home of Record (HOR) as Fort Rucker, Alabama. 2. The applicant states that he was living in Alabama at the time of his entry on active duty. 3. The applicant provides a copy of his DD Form 214 (Certificate of Release or Discharge from Active Duty) and his Officer Record Brief (ORB). CONSIDERATION OF EVIDENCE: 1. The applicant completed a DA Form 61 (Application for Appointment) in September 1989 which indicates his permanent address as Medina, Ohio. Block 21 on his appointment application shows he was scheduled to graduate from Auburn University in Alabama in June 1990. His DA Form 597-3 (Army Senior Reserve Officers’ Training Corps (ROTC) Scholarship Cadet Contract) shows his address of record as Medina, Ohio. 2. Headquarters, U.S. Army Third Region, Fort Riley, Kansas orders Number 130-4-A-593, dated 10 July 1990, ordered the applicant to active duty for assignment to Company D, 1st Battalion, 145th Aviation Regiment, Fort Rucker, Alabama with a reporting date of 31 August 1990. These orders show his HOR as Medina, Ohio. 3. After having had prior enlisted service, the applicant was appointed as a commissioned officer on 30 August 1990. His memorandum of appointment shows his address as Medina, Ohio. 4. Section IV (Personal/Family Data) on the applicant’s ORB, dated 5 March 2007, shows his HOR at his entry on active duty (EAD) as “OHIO.” 5. Headquarters, Fort McPherson Orders Number 073-0002, dated 14 March 2007, released the applicant from active duty for retirement on 31 December 2007 and placed him on the retired list on the following date. These orders show his HOR as “MEDINA OH.” 6. Item 7b on the applicant’s DD Form 214 shows his HOR as “MEDINA OHIO.” 7. Army Regulation 635-5 prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for the preparation of the DD Form 214. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement or discharge. In pertinent part, it directs that the HOR at time of entry will be entered in Block 7b of the DD Form 214. This regulation states that the street, city, state and zip code will be entered. HOR is the place recorded as the home of the individual when commissioned, appointed, enlisted, inducted, or ordered into the relevant tour of active duty. The place recorded as the home of the individual when reinstated, reappointed, or reenlisted remains the same as that recorded when commissioned, appointed, enlisted, or inducted or ordered into the relevant tour of active duty unless there is a break in service of more than one full day. DISCUSSION AND CONCLUSIONS: 1. The applicant was appointed on 30 August 1990. At that time, the city and state of his HOR were recorded as Medina, Ohio. His appointment application, ROTC scholarship contract, and his active duty orders show his HOR as Medina, Ohio. 2. The preponderance of evidence shows the applicant’s HOR was Medina, Ohio at the time of his entry on active duty in August 1990. Therefore, his DD Form 214 correctly reflects his HOR as Medina, Ohio in item 7b.
