THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his Certificate of Release or Discharge from Active Duty (DD Form 214) to show that he was awarded the Purple Heart. 2. The applicant states that he received the medal and the orders awarding him the Purple Heart; however, it was not included on his DD Form 214. 3. The applicant provides in support of his application, a copy of the Permanent Orders 193-03, issued by Headquarters, Multi-National Corps Iraq, dated 12 July 2005, awarding him the Purple Heart; and a copy of his DD Form 214. CONSIDERATION OF EVIDENCE: 1. On 8 October 2003, the applicant enlisted in the Regular Army in Phoenix, Arizona, for a period of 3 years, in the pay grade of E-1. He successfully completed his training as an infantryman. 2. A report of medical examination dated 28 March 2006 noted that the applicant suffered a gunshot wound to his right thigh (hamstring) in June 2005. 3. On 11 September 2003, the applicant was discharged under honorable conditions under the provisions of Army Regulation 635-200, chapter 14-12c, due to misconduct, commission of a serious offense. The DD Form 214 that he was furnished at the time of his discharge shows that he was awarded the National Defense Service Medal, the Global War on Terrorism Service Medal, the Korea Defense Service Medal, the Iraq Campaign Medal, the Army Service Ribbon, the Overseas Service Ribbon, and the Combat Infantryman Badge. 4. The applicant submitted in behalf of his application, a copy of Permanent Orders Number 193-031 dated 12 July 2005, which shows that he was awarded the Purple Heart on 4 June 2005, for wounds received as a result of enemy or hostile actions, while he was serving in the rank of private first class (E-3). However, the Purple Heart was never included on his DD Form 214. 5. Army Regulation 600-8-22 (Military Awards) provides, in pertinent part, that the Purple Heart is awarded for a wound sustained while in action against an enemy or as a result of hostile action. Substantiating evidence must be provided to verify that the wound was the result of hostile action, the wound must have required treatment by military medical personnel, and the medical treatment must have been made a matter of official record. DISCUSSION AND CONCLUSIONS: 1. It appears that an error was made during the preparation of the applicant's DD Form 214 which resulted in the Purple Heart being omitted. 2. The applicant's records show that he suffered a gunshot wound to his right thigh (hamstring) in June 2005. Permanent Orders 193-031 dated 12 July 2005, were published awarding him the Purple Heart for wounds that he received as a result of enemy or hostile actions on 4 June 2005, while he was serving in the rank of private first class (E-3). 3. He was wounded in action on 4 June 2005. Consequently, he was awarded the Purple Heart. Therefore, it would now be appropriate to amend his DD Form 214 to include this decoration.
