	The applicant and counsel if any, did not appear before the Board.

	The Board considered the following evidence:

FINDINGS:

1.  The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.

2.  The applicant requests payment of his annual Medical Additional Special Pay (MASP) for the period 1 July 1995 through 30 June 1996.

3.  He states, in effect, he was not aware he had to execute a specific request to receive the pay and assumed the extension of was sufficient.

4.  Records available to the Board indicate the applicant served an initial period of active duty between 1966 and 1968.  On 17 May 1983 he returned to active duty and via a series of short term extensions ultimately acquired an obligated service date ending on 30 June 1996. On 30 June 1996 the applicant was retired under one of the Army’s voluntary early retirement programs.

5.  In processing this application the Office of the Surgeon General advised that the applicant was eligible to execute a MASP agreement for $15,000 for the period 1 July 1995 through 30 June 1996 based on his final short-term extension and that it was “no fault of the officer that the MASP contract was not processed for payment.”  They recommended his request be approved.

CONCLUSIONS:

1.  The evidence indicates the applicant was entitled to Medical Additional Special Pay in the amount of $15,000 based on his voluntary extension of active duty until 30 June 1996.

2.  In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the individual concerned is entitled to payment of $15,000 for 
Medical Additional Special Pay for the agreement period effective 1 July 1995 through 30 June 1996.
