2. The applicant requests that his WD AGO Form 53-98, Military Record and Report of Separation, be corrected to reflect that he was separated as a captain instead of a first lieutenant. 3. He states that he was released from active duty and placed on terminal leave from 29 November 1945 through 20 February 1946. On 31 December 1945 he was promoted to the grade of captain. Although his WD AGO Form 53-98 was not completed until 20 February 1946 it did not reflect his grade as captain. In support of his request he provides copies of his promotion certificate, orders placing him on terminal leave and his final pay and allowances documents showing that he was paid for the promotion to captain. 4. The applicant’s military records were lost or destroyed in the National Personnel Records Center fire of 1973. Information herein was obtained from alternate sources. 5. His military records show that he was appointed in the officer reserve corps as a second lieutenant and entered on active duty on 10 July 1942. He was subsequently promoted to first lieutenant and served 1 Year, 10 months and 28 days in the Asiatic-Pacific Theater of Operations. He was honorably separated from active duty on 20 February 1946. Upon his separation he was granted terminal leave of 2 months, 21 days and 1 day of travel time resulting in his release date of 20 February 1946. 6. The orders directing terminal leave indicated that AUS (Army of the United States) appointments held continued in force during the current emergency plus 6 months unless they were sooner terminated. CONCLUSIONS: 1. Documents provided with the applicant’s request and evidence in his official military file appear to show that he was promoted to the grade of captain effective 31 December 1945. 2. Accordingly, his WD AGO Form 53-98 should be corrected to show his grade as captain on his release from active duty. 3. In view of the foregoing, it would be appropriate to correct the applicant’s records as recommended below. RECOMMENDATION: That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was promoted to the grade of captain on 31 December 1945.
