APPLICANT REQUESTS: That item #3 (grade/rank) on his DD Form 214, Report of Transfer or Discharge, be corrected to show that he was a staff sergeant (SSG), pay grade E-6. APPLICANT STATES: That, in effect, his DD form 214 is incorrect because it shows his grade as a specialist five, E-5. In support of his contention, he provides a copy of orders appointing him to the consolidated mess council and showing his grade as SSG. EVIDENCE OF RECORD: The applicant's military records show: He was inducted on 14 August 1952 and through a series of reenlistments remained on active duty until his honorable discharge on 29 October 1962. The highest grade he held was SSG. The order supplied by the applicant showing his grade as a SSG is dated 15 February 1962. His record shows that he was promoted to the grade of SSG on 31 August 1961 and reduced to specialist five on 22 March 1962 for inefficiency, an action that he acknowledged at the time and indicated he did not desire to appeal. DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded: 1. The record shows that he was reduced to the grade of specialist five after the date of the order he claims proves that his grade was SSG. Therefore, in the absence of evidence to the contrary, the grade of specialist five reflected in item #3 of his DD Form 214 is correct and no change is warranted. 2. In view of the foregoing, there is no basis for granting the applicant’s request. DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
