APPLICANT REQUESTS: That his DD Form 214, Release or Discharge from Active Duty, be corrected to reflect that he was awarded a campaign medal for participation in Operation Desert Storm. APPLICANT STATES: In effect, that his Patriot Missile Battery served in Tel Aviv, Israel from January through 5 March 1991 and he should be awarded the Southwest Asia Service Medal (SWASM) for this service. EVIDENCE OF RECORD: The applicant's military records show: He enlisted in the Regular Army for 3 years on 26 October 1988 and after training as an Air Defense Artillery, Operations and Intelligence Assistant, he served 1 year, 11 months and 14 days in Germany. He was honorably separated by reason of a hardship discharge on 11 March 1991. It was during his assignment in Germany that he contends his unit was assigned to Tel Aviv, Israel, apparently on a temporary duty basis, and he participated in Operation Desert Storm. However, there is no evidence in his military records, in the form of orders and/or entries on the personnel qualification record to show that he served in Operation Desert Storm or, that his unit served there. Army Regulation 600-8-22, Military Awards, prescribes Department of the Army policy, criteria, and administrative instructions concerning individual military awards. It states, in pertinent part, that the SWASM is awarded to all members of the Armed Forces of the United States serving in Southwest Asia and contiguous waters or airspace thereover, on or after 2 August 1990 to 30 November 1995. DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded: 1. The applicant has provided no evidence and there is none in his personnel records to indicate that he served in Southwest Asia or that he is authorized the award of the SWASM. 2. In view of the foregoing, there appears to be no basis for granting the applicant’s request. DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
