The applicant requests that his date of rank (DOR) for promotion to specialist (E-4) be adjusted to 5 January 1995 and that he receive any back pay and allowances due as a result of this adjustment. 3. He states that he was unable to provide a translated copy of his college transcript at the time of his enlistment which would have authorized his enlistment in the grade of specialist. 4. In support of his request, the applicant has provided a certified copy of his college transcript which, in accordance with appropriate regulations, authorizes his enlistment in the grade of specialist. 5. In an advisory opinion to this Board the US Army Total Army Personnel Command recommends that the applicant’s records be changed to reflect that he was enlisted in the grade of specialist (E-4) effective 5 January 1995. 6. Army Regulation 601-210, Regular Army and Army Reserve Enlistment Program, provides in pertinent part, that an applicant may be enlisted at a higher grade than private upon presentation of documentary evidence of successful completion of college credits entitling him or her to a higher grade. CONCLUSIONS: 1. The applicant has provided the proper documentation to support his enlistment in the grade of specialist (E-4) on 5 January 1995. Accordingly, his DOR should be adjusted to that date and he should be granted back pay and allowances effective as of that date. 2. In view of the foregoing, the applicant’s records should be corrected as recommended below. RECOMMENDATION: That all of the Department of the Army records related to this case be corrected: a. by showing that the individual concerned was enlisted in the grade of specialist (E-4) with a DOR of 5 January 1995; and b. by showing that he is authorized to receive any and all back pay and allowances due him since 5 January 1995.
