2. The applicant requests remission or cancellation of indebtedness in the amount of $585.68 which was collected prior to the commander’s approval of the remission of indebtedness. 3. The applicant’s military records show that he is currently serving on active duty in pay grade E-6. In 1994, he made an intra-theater move from Berlin to Hohenfels, Germany. Subsequently, he was informed that he was indebted to the Government in the amount of $890.88 for excess shipment of household goods. The applicant’s request for remission of indebtedness was approved, (the date of the action is not available); however, $585.68 previously collected were not reimbursed. 4. In the processing of this case, a staff advisory opinion was obtained from the Defense Finance and Accounting Service/Indianapolis (DFAS/I) which advised that the original debt basis and amount were partially invalid; that the applicant owed the Government only $79.84 for 234 lb of excess weight household goods. However since $585.68 was previously withheld from his pay, he is entitled to a reimbursement of $505.84. CONCLUSIONS: 1. The basis for the applicant’s indebtedness was an overweight shipment of household good. However, since the basis for the amount was partially invalid, he owes the Government only $79.84 vice the $585.68 which was deducted from his pay. 2. In view of the foregoing, it would be just to reimburse the applicant for the difference in the amount of $505.84. RECOMMENDATION: 1. That all of the Department of the Army records related to this case be corrected by showing that the individual concerned is entitled to reimbursement of $505.84. 2.
