2.  The applicant requests that his reenlistment contract (DD Form 4/1) dated 4 April 1995 be corrected to reflect that he reenlisted in military occupational specialty (MOS) 54B with entitlement to a Selective Reenlistment Bonus (SRB)-0.5A. 

3.  The applicant states that he reenlisted for training as a combat medic (91B).  However, his reenlistment NCO failed to inform him that if he was promoted to the pay grade of  E-5 he would disqualify himself from attendance at 91B training.  Consequently, after being promoted to the pay grade of E-5 he was informed that he was no longer eligible to attend 91B training and that he must continue to serve in MOS 54B.   He goes on to state that MOS 54B offered an SRB at the time and that he should be entitled to receive it.

4.  The applicant’s military records show that after serving 3 years, 6 months, and 2 days of total active service, he reenlisted on 4 April 1995 for a period of 3 years and training in MOS 91B (medical specialist).  His contract indicates no bonus entitlement. 

5.  On 11 August 1995, upon completion of the Primary Leadership Development Course (PLDC), the applicant was promoted to the pay grade of E-5 in MOS 54B.

6.  In the processing of this case, an advisory opinion was obtained from the Total Army Personnel Command (PERSCOM).  It opined, in effect, that the applicant was not qualified, by virtue of being a promotable E-4, to reenlist for the 91B service school.  The PERSCOM further opined that the applicant’s MOS of 54B offered an SRB of 0.5A and recommended that the applicant’s reenlistment contract dated 4 April 1995 be amended to reflect that the applicant reenlisted in MOS 54B, with entitlement to an SRB-0.5A in MOS 54B.

CONCLUSIONS:

1.  The applicant was improperly advised that he could reenlist for Army service school training in MOS 91B, when, by virtue of his promotable status, he was ineligible for such an option.  Consequently, the applicant was denied the opportunity to exercise another option for which he was qualified or receiving a SRB in his present MOS.

2.  Therefore, inasmuch as the applicant was serving and continues to serve in MOS 54B, it would be appropriate for him to receive an SRB for that MOS.

3.  In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by amending the 4 April 1995 reenlistment contract of the individual concerned to reflect that he reenlisted with entitlement to an SRB-0.5A in MOS 54B, and that the entitlement to attend Army Service School Course 91B be deleted.
