2. The applicant requests that the effective date of his promotion to pay grade E-5 be corrected. 3. In support of his application he submits a copy of an order showing he was promoted from pay grade E-4 to pay grade E-5 on 26 April 1991, with a date of rank of 1 February 1991. 4. The applicant’s records show that he enlisted in the USAR for assignment to a troop program unit on 7 October 1987 in pay grade E-4 with prior active and reserve service. 5. Army Regulation 140-158, paragraph 1-9, then in effect, which contained the guidelines for correcting the effective date of a promotion, specified that the effective date of a promotion/advancement will be the date of the order or personnel action or a future date. In those cases where a soldier was entitled to an effective date of promotion or advancement before the date of the order or personnel action, he or she was required to petition this Board for authority to correct the effective date of the promotion or advancement. CONCLUSIONS: 1. The applicant was promoted to pay grade E-5 with a retroactive date of rank. 2. In view of the foregoing, the applicant’s records should be corrected as recommended below. RECOMMENDATION: That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was promoted to pay grade E-5 effective 26 April 1991.
