2.  The applicant requests that his records be corrected to show that he received a general discharge (GD) in lieu of a discharge under conditions other than honorable (UOTHC).

3.  On 22 September 1970, the applicant enlisted in the Regular Army.  He completed his required training and was awarded military occupational specialty 21A (Pioneer).

4.  On 3 February 1972, he accepted nonjudicial punishment (NJP) under Article 15, Uniform Code of Military Justice, for being absent without leave for the period 19-28 January 1972.  His punishment consisted of a reduction, a forfeiture and extra duty.

5.  On 15 March 1972, he was advised by his unit commander that he was being recommended for separation based on his prior NJP and several counselling statements, under Army Regulation 635-212 and of his rights.  The applicant waived consideration and personal appearance before a board of officers; elected not to submit statements in his own behalf; and, waived legal counsel.

6.  On 2 May 1972, the appropriate separation authority approved his separation and directed a GD be furnished.

7.  On 11 May 1972, the applicant was separated, with a GD, under the above cited regulation.  His Report of Separation indicated he had 1 year, 7 months and 20 days of creditable service.  He was entitled to award of the National Defense Service Medal and the Parachute Badge.  He was issued a General Discharge Certificate. 

CONCLUSIONS:

1.  The evidence of record shows that he received a GD and his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge), dated 11 May 1972, should be corrected accordingly.

2.  The evidence also shows that he had 10 days of lost time and his record should also show this.

3.  In view of the foregoing, he should have his records corrected, as shown below.
RECOMMENDATION:

That his DD Form 214 be corrected by showing that he received a GD and that he had 10 days of lost time.
