2.  The applicant requests that her records be corrected to reflect that she was authorized to enlist in the pay grade of E-2 and that she is entitled to back pay and allowances from the date of her enlistment until 9 May 1995.

3.  The applicant states that at the time of her enlistment she did not have a copy of her college transcripts and therefore had to enlist in the pay grade of E-1.  However, on 12 April 1995 she presented her transcripts to her commander and was advanced to the pay grade of E-2 with a retroactive effective date and date of rank of 9 November 1994.  She further states that she has not received her pay for her advancement during the period 9 November 1994 through 9 May 1995.  In support of her application, she submits copies of her promotion documents and transcripts.

4.  The applicant’s military records show that she enlisted on 9 November 1994 for a period of 3 years in the pay grade of E-1.

5.  In the processing of this case, an advisory opinion was obtained from the Total Army Personnel Command (PERSCOM).  It opined that the applicable regulations authorized the applicant entry in the pay grade of E-2 (based on completion of thirty or more semester hours from an accredited college).  The PERSCOM recommended that her records be corrected to reflect that she enlisted in the pay grade of E-2.

6.  Army Regulation 601-210 governs eligibility criteria, policies, and procedures for enlistment and processing of persons into the Regular Army.  It states, in pertinent part, persons who have completed thirty to fifty-nine semester hours of an accredited university may be enlisted in the pay grade of E-2.  Applicants who lack the documentation required for advancement may submit supporting documentation to his or her personnel officer within 12 months of active service and will be advised to apply to the Board for correction of their records and adjustments of pay.   


CONCLUSIONS:

1.  The applicant was qualified to enlist in the pay grade of E-2.  However, because she did not present the necessary documentation (college transcripts) at the time of her enlistment, she was enlisted in the pay grade of E-1. 

2.  The applicant subsequently provided the necessary documentation and was advanced retroactive to the date of her enlistment.  Consequently, her records should be corrected to reflect her enlistment in the pay grade of E-2.

3.  Likewise, she should also receive all back pay and allowances she is entitled to receive as a result of her promotion. 

4.  In view of the foregoing, it would be appropriate to correct the applicant’s records as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by amending the 9 November 1994 enlistment contract of the individual concerned to show that she enlisted in the pay grade of E-2 and that she be paid all back pay and allowances to which she is entitled.
