APPLICANT REQUESTS:  That his DD Form 214, Report of Transfer or Discharge, be corrected to reflect that he was awarded the Purple Heart and the Bronze Star Medal with “V” device (BSM).

APPLICANT STATES:  That the two medals requested were left off of his DD Form 214.

EVIDENCE OF RECORD:  The applicant's military records show:

He enlisted in the Regular Army for 3 years on 13 October 1965 and after training as a radio operator served 1 year, 5 months, and 24 days in Vietnam.  He was honorably discharged on 12 September 1968.

The record also reflects that on 7 July 1968 general order 223, 71st Evacuation Hospital, awarded him the Purple Heart for wounds received in Vietnam on 6 July 1968.

The record contains no evidence, however, that he was either recommended for or awarded a BSM with “V” during his service.

Army Regulation 600-22-8, Military Awards, provides, in pertinent part, that the Bronze Star Medal is awarded to any person who, while serving in any capacity in or with the Army of the United States after 6 December 1941, distinguished himself by heroic or meritorious achievement or service, not involving participation in aerial flight, in connection with military operations against an armed enemy; or while engaged in military operations involving conflict with an opposing armed force in which the United States is not a belligerent party.  A “V” device is worn to denote participation in acts of heroism involving conflict with an armed enemy.

DISCUSSION:  Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:

1.  Based on a review of the available records, there is no documentation to suggest that he was recommended for or awarded the BSM or the BSM with “V”.

2.  In view of the foregoing, there appears to be no basis for granting the applicant’s request.

DETERMINATION:  The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.

NOTE:  Since the record reflects that he was awarded the Purple Heart, the Commander, US Army Reserve Personnel Center will be requested to correct his records accordingly.
