APPLICANT REQUESTS: That his reentry (RE) code be changed from RE-3C to RE-1A on his DD Form 214, Certificate of Release or Discharge from Active Duty. APPLICANT STATES: He was honorably released from active duty and completed his statutory military service obligation in a USAR unit. EVIDENCE OF RECORD: The applicant's military records show: He enlisted in the Regular Army for 2 years on 14 November 1986 in pay grade E-1, reenlisted for 4 years on 20 May 1988 in pay grade E-3, and was honorably released from active duty on 13 February 1992 in pay grade E-4 and transferred to a USAR unit the following day. The DD Form 214 he was issued shows he was assigned an RE code of RE-3C. It also shows he completed 5 years and 3 months of creditable service. He received several awards to include the Good Conduct Medal and the Army Achievement Medal. Pertinent Army regulations provide that prior to discharge or release from active duty, individuals will be assigned RE codes, based on their service records or the reason for discharge. Army Regulation 601-210 covers eligibility criteria, policies, and procedures for enlistment and processing into the Regular Army and the US Army Reserve. Chapter 3 of that regulation prescribes basic eligibility for prior service applicants for enlistment. That chapter includes a list of armed forces RE codes. RE-3C applies to persons who have completed more than 4 months service who do not meet the basic eligibility pay grade requirements of chapter 2, Army Regulation 601-280. In other words, he served more than 5 years of active service without achieving a grade higher than E-4. DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record and applicable law and regulations, it is concluded: 1. The applicant did not meet the basic eligibility pay grade requirements of chapter 2, Army Regulation 601-280 to reenlist. Therefore, the code RE-3C was properly assigned to him and there is no reason to change it. 2. In view of the preceding, there is no basis for granting the applicant’s request. DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
