His entry level separation be changed. 2. His separation (SPD) code of “JFC” (Erroneous Entry (Other)) be changed. ________________________________________________________________ _ APPLICANT CONTENDS THAT: He believes his characterization of service and separation code is an error, but it is not his fault. He would like his records corrected so that he can reenter into the Air Force. In support of his request, the applicant provides a personal statement. His complete submission, with attachment, is at Exhibit A. ________________________________________________________________ _ STATEMENT OF FACTS: The applicant enlisted into the Regular Air Force on 11 Oct 11. The applicant’s commander notified him that he was recommending him for discharge for Erroneous Enlistment; citing that he had a law violation that was not documented on his security questionnaire. He acknowledged receipt of the discharge notification and waived his rights to submit statements in his own behalf. He received an entry level discharge on 7 Dec 11 after serving 1 month and 27 days on active duty. The remaining relevant facts pertaining to this application are contained in the letter prepared by the appropriate office of the Air Force, which is at Exhibit C. ________________________________________________________________ _ AIR FORCE EVALUATION: AFPC/DPSOR recommends denial. The applicant’s service characterization is correct as reflected on his DD Form 214, Certificate of Release or Discharge from Active Duty. His discharge was consistent with the procedural and substantive requirements of the discharge regulation and was within the discharge authority’s discretion. Additionally, airmen are given an entry level separation and uncharacterized service when separation is initiated in the first 180 days of continuous active service. The complete DPSOR evaluation is at Exhibit C. ________________________________________________________________ _ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 10 Jul 13 for review and comment within 30 days. As of this date, this office has received no response. ________________________________________________________________ _ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. In this respect, the evidence of record indicates the applicant was given an entry level separation and a SPD code of “JFC” for his erroneous entry into the Air Force. He has provided no evidence which would lead us to believe his entry level separation was improper or contrary to the provisions of the governing instruction, or the SPD code was not appropriately assigned.
