RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2012-02852 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: His Fitness Assessment (FA) dated 12 March 2012 be removed from her records. _________________________________________________________________ APPLICANT CONTENDS THAT: He was seen in flight medicine by the independent duty medical technical and not a doctor for back issues and was put on a duty limiting waiver. He then took his FA and was unable to complete the push-up portion of the test because his back gave out resulting in a failure. The next day he went to the doctor and received a new duty limiting waiver. The applicant’s complete submission, with attachments, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant is currently serving in the Regular Air Force in the grade of senior airman. The applicant’s last five FA scores are as follows: DATE SCORE 7 February 2011 UNSATISFACTORY 6 May 2011 SATISFACTORY 21 November 2011 UNSATISFACTORY * 12 March 2012 UNSATISFACTORY 28 August 2012 UNSATISFACTORY *Contested FA score. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIM recommends approval. DPSIM recommends the push-up component of the FA dated 12 March 2012 be updated to reflect “exempt” in the AFFMS. The applicant provided an AF Form 469, Duty Limiting Condition Report, dated 13 March 2012, stating no push-ups. The overall composite score will change to reflect 85.25 (Satisfactory). The complete DPSIM evaluation, with attachments, is at Exhibit B. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: The applicant provided additional documentation in support of his appeal. The applicant’s response, with attachments, is at Exhibit D. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice to warrant removing the contested FA from the applicant’s records. While the applicant requests the entire FA be removed, the AF Form 469 only exempted him from the push-up portion of the FA and not the other components. As such, we find the abdominal circumference, cardio, and sit-up components of the FA should remain undisturbed. 4. Notwithstanding the above, sufficient relevant evidence has been presented to warrant correcting the applicant’s records to show that he was exempt from participating in the push-up component of the contested FA, which will change his overall composite score to reflect 85.25, a “Satisfactory” rating. In view of the fact the applicant had a duty limiting condition that exempted him from the push-up component of the contested FA, we agree with the opinion and recommendation of DPSIM and accept its rationale as the basis for our recommendation that his records be corrected to the extent indicated below. _________________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT be corrected to show that the push-up component of the Fitness Assessment dated 12 March 2012 be amended to reflect “exempt” in the Air Force Fitness Management System. _________________________________________________________________ The following members of the Board considered AFBCMR Docket Number BC-2012-02852 in Executive Session on 4 April 2013, under the provisions of AFI 36-2603: All members voted to correct the records, as recommended.
