RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2011-03152 COUNSEL: NONE HEARING DESIRED: NOT INDICATED _____________________________________________________________ APPLICANT REQUESTS THAT: His DD Form 214, Armed Forces of the United States Report of Transfer or Discharge, be corrected to reflect his service in Vietnam. _____________________________________________________________ APPLICANT CONTENDS THAT: He served 13 months in Vietnam from 1965 to 1966. The applicant's complete submission is at Exhibit A. _____________________________________________________________ STATEMENT OF FACTS: The applicant served on active duty in the Regular Air Force from 12 Feb 62 to 11 Jan 67. His DD Form 214 reflects a total of 4 years and 11 months active service, which includes 2 years, 5 months, and 27 days of Foreign Service. The Vietnam Service Medal (VSM), created on 8 Jul 65, is awarded to all service members of the Armed Forces who, between 4 Jul 65 and 28 Mar 73, served in the following areas of Southeast Asia: in Vietnam and the contiguous waters and airspace; in Thailand, Laos or Cambodia or the airspace there over in the direct support of military operations in Vietnam. A member must meet one of the following criteria to be eligible: 1. Attached to or regularly serving for one, or more, days with an organization participating in or directly supporting ground (military) operations, 2. Attached to or regularly serving for one, or more, days aboard a naval vessel directly supporting military operations, 3. Actually participate as a crew member in one or more aerial flights directly supporting military operations, or 4. Serve on TDY for 30 consecutive days or 60 nonconsecutive days, which may be waived for personnel participating in actual combat operations. _____________________________________________________________ AIR FORCE EVALUATION: HQ AFPC/DPAPP recommends denial. DPAPP states they could not verify any time served in Vietnam; however, they did verify the applicant was stationed in Okinawa, Japan, from 29 Oct 62 to 26 Apr 64. The only other location they could verify he was stationed is Barksdale AFB, LA. The complete DPAPP evaluation is at Exhibit C. _____________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: The applicant states while stationed at Barksdale AFB, LA, he served on TDY to Ton Son Nhut Air Base, Republic of Vietnam for 13 months in 1965 and 1966. He would like his records corrected to reflect this service. The applicant’s complete response is at Exhibit E. ______________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. After thoroughly reviewing the evidence of record, we are not persuaded the requested relief should be granted. The applicant states he served on a temporary duty assignment to Ton Son Nhut Air Base, Republic of Vietnam for 13 months; however, we do not find his assertions sufficiently persuasive to override the rationale provided by the Air Force office of primary responsibility (OPR). Therefore we agree with the opinion and recommendation of the AF OPR and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error or an injustice.
