RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2011-02954 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: His record be corrected to reflect a satisfactory year of service for retirement for the period 28 April 2010 to 27 April 2011 and that he be credited with the accompanying points for retirement for the same period of service. ________________________________________________________________ APPLICANT CONTENDS THAT: He was unable to perform the primary duties of his Air Force Specialty Code (AFSC) for a period of approximately three months due to an injury and subsequent surgery. As a result, he did not obtain the minimum of 35 training points required for his duty status or a total of 50 points for a satisfactory year a service towards retirement. In support of his appeal, the applicant provides a copy of a civilian medical operative report. The applicant’s complete submission, with attachment, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: AFRC/A1K recommends denial. A1K states that in accordance with Air Force Instruction 36-2254, Volume I, “Points may only be credited to the date a member actually performed the duty, except in those activities where the cumulative method is authorized, such as telecommuting.” Given the applicant did not meet the medical standards to be considered medically qualified to participate in any pay or point gaining activity during the period in question, the command’s policy that these periods of service under such conditions may be excused is applicable. However, the command policy does not allow for point crediting toward a satisfactory year toward retirement as requested by the applicant. A1K indicates that if it is the Board’s decision to grant the relief sought, then the applicant’s record should be corrected to show an additional nine non-paid inactive duty training points for Retention/Retirement year 28 April 2010 to 27 April 2011, for a total of 50 points and a satisfactory year of service towards retirement. The complete A1K evaluation, with attachments, is at Exhibit B. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: On 16 December 2011, a copy of the Air Force evaluation was forwarded to the applicant for review and comment within 30 days (Exhibit C). As of this date, this office has received no response. ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt their rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice.
