RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2011-02447 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: His DD Form 214, Armed Forces of the United States Report of Transfer or Discharge, be updated to reflect award of the Air Force Commendation Medal (AFCM). _________________________________________________________________ APPLICANT CONTENDS THAT: He is entitled to the AFCM for his participation as part of a four man team that was sent to Wheelus Air Base in 1967 on sealed orders to support Israel during a six day war with Libya. He was told he would receive the medal when he returned to England. In support of his request, the applicant provides a copy of his DD Form 214. The applicant’s complete submission, with attachment, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant’s DD Form 214 reflects he served from 23 Nov 63 through 19 Nov 67. He was credited with three years, four months, and four days of Foreign Service. The applicant’s AF Form 7, Airman Military Record, reflects the applicant served in England from 15 Jul 64 through 18 Nov 67. The AFCM is awarded to service members of the Armed Forces who served in any capacity with the Air Force after 24 Mar 58, who distinguished themselves by meritorious achievement and service. The degree of merit must be distinctive. The acts of courage does not have to involve the voluntary risk of life required for the Soldier’s Medal (or the Airman’s Medal now authorized for the Air Force) may be considered for the AFCM. The remaining relevant facts pertaining to this application are contained in the letter prepared by the appropriate office of the Air Force, which is attached at Exhibits C. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIDR reviewed this application and recommends denial noting there was no official documentation provided or located in the applicant’s military records to substantiate the applicant was awarded or recommended for the AFCM. Furthermore, there was no documentation found in the applicant’s record reflecting he served at Wheelus AFB. The complete AFPC/DPSIDR evaluation is at Exhibit C. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to applicant on 19 Aug 11 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. After careful consideration of the applicant's request and the available evidence of record, we find insufficient evidence of error or injustice to warrant corrective action. The facts and opinions stated in the advisory opinion appear to be based on the evidence of record and have not been adequately rebutted by the applicant.
