RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2011-00522 COUNSEL: NO HEARING DESIRED: YES _________________________________________________________________ APPLICANT REQUESTS THAT: His record be corrected to reflect he was reassigned to Inactive Status List Reserve Section (ISLRS) effective 1 June 2006. _________________________________________________________________ APPLICANT CONTENDS THAT: In June 2006, he transferred from the United States to Singapore with his civilian job. His unit was aware of this move and should have immediately transferred him to ISLRS in order to properly and efficiently utilize limited Reserve resources as it was clear that he would be unable to fulfill his duties from Singapore. Had his unit followed appropriate management practice, he would have been transferred immediately into ISLRS in June 2006 and his “promotion clock” would have stopped, thus making him ineligible for the 2009 Lieutenant Colonel (O-5) Promotion Board. Thus his first eligible O-5 promotion board should occur in 2012 rather than 2009. In support of his appeal, the applicant provides a personal statement, and copies of his notification of second deferral for promotion; a chronological sequence of career events; correspondence between the applicant and his civilian employer; electronic communications with his military chain of command; and his request to be reassigned to ISLRS, dated 18 February 2007. The applicant’s complete submission, with attachments, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant is a former member of the Air Force Reserve who served as an Individual Mobilization Augmentee (IMA) in the grade of major. The applicant requested he be reassigned to an inactive Reserve status on 18 February 2007 due to a change of residence to Singapore. According to Reserve Order DA-02381, dated 18 March 2008, the applicant was reassigned to the Non- obligated, Non-participating Ready Personnel Section (NNPRS). The applicant’s records were considered and not selected for promotion by the 2009 and 2010 O-5 promotion boards. On 20 August 2010, the applicant was notified by ARPC, Personnel Program Management, that he was twice deferred for promotion to O-5; therefore, according to Title 10, United States Code, Section 14506, he must be discharged. Reserve Order CB-72, dated 11 May 2011, indicates the applicant was honorably discharged from all appointments in the United States Air Force effective 1 June 2011. _________________________________________________________________ AIR FORCE EVALUATION: AFRC/A1K recommends denying the applicant request to correct his record to reflect reassignment to ISLRS effective 1 June 2006. A1K states that in accordance with the command’s voluntary reassignment policy procedures, the applicant’s reassignment date should be effective six months from the date of his request for voluntary reassignment. Therefore, they recommend changing the record to reflect the applicant was reassigned to ISLRS effective 18 August 2007, six months from the date of his request for reassignment (dated 18 February 2007). The complete A1K evaluation, with attachments, is at Exhibit C. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: He disagrees with A1K’s recommendation of reassignment into inactive Reserve status as of 18 August 2007. This opinion does not address Air Force Instruction 36-2115, paragraph 4.4.2.2 as cited in his original application. He has provided evidence that his supervisors and unit Reserve administrative staff were aware of his move to Singapore on 1 June 2006. He would agree to a date of 1 December 2006 as it represents six months from his move to Singapore. The applicant’s complete rebuttal is at Exhibit E. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an injustice to warrant partial relief. We note the applicant is requesting that his record be corrected to show he was assigned to ISLRS effective 1 June 2006 based on the fact that his chain of command was aware of his move to Singapore; however, the evidence of record reflects he did not request reassignment to an inactive status because of his move until 18 February 2007. According to the Air Force office of primary responsibility (OPR), command policy states that when a member voluntarily requests to be reassigned to an inactive status, his reassignment effective date will be six months from the date of the member’s request. Based on this policy and the date of the applicant’s request, we agree with the recommendation made by the Air Force OPR and recommend the applicant’s record be corrected as indicated below. 4. The applicant's case is adequately documented and it has not been shown that a personal appearance with or without counsel will materially add to our understanding of the issue(s) involved. Therefore, the request for a hearing is not favorably considered. _________________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT be corrected to reflect that: a. He was reassigned to the Inactive Status List Reserve Section (ISLRS) effective 18 August 2007. b. His records were not considered for promotion to the grade of lieutenant colonel (O-5) by the Calendar Year 2009 United States Air Force Reserve Participating Line and Health Professionals Lieutenant Colonel Promotion Selection Board. c. He was not discharged from all appointments in the United States Air Force effective 1 June 2011, but was continued in his Reserve assignment. d.
