RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2010-03356 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: Block II of her DD Form 2839, Career Status Bonus (CSB) Election, be changed to reflect “Eligible to elect the Career Status Bonus” rather than “Not eligible to elect the Career Status Bonus.” _________________________________________________________________ APPLICANT CONTENDS THAT: She is an Active Guard Reserve (AGR) and recently made career status; therefore, she is now eligible to elect CSB. The applicant does not provide any evidence in support of her appeal. The applicant’s complete submission is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant’s military personnel records are not available for review. On 18 March 2011, SAF/MRBR contacted the applicant asking her to provide a copy of the DD Form 2839 in question. However, to this date, they have received no response. According to AFRC/CSS (Air Force Reserve Command, Chief Personnel Programs) the applicant has been extended to a Total Active Military Service Date of 15 July 2012. _________________________________________________________________ AIR FORCE EVALUATION: AFRC/CSS recommends denial. CSS states that in accordance with Air Force Instruction 36-2132, paragraph 2.7.3.1.3, a member must have completed 15 years of active duty in Uniformed Services, be eligible to be selected to continue on active duty until completion of 20 years of service, and have executed a written agreement to remain on continuous active duty until completion of 20 years of active duty in order to be eligible for CSB. CSS indicates that in 2007 (CSB eligibility year), the applicant was not granted a CSB because she had not been an AGR for six years to qualify. She is not currently in career status. There is no documentation supporting her request to retroactively be awarded a CSB as she was ineligible at the time of election. The complete AFRC/CSS evaluation is at Exhibit C. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 4 March 2011, for review and comment within 30 days. As of this date, this office has received no response. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or an injustice. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice.
