RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2010-01971 COUNSEL: NONE HEARING DESIRED: NOT INDICATED _________________________________________________________________ APPLICANT REQUESTS THAT: 1. He be awarded foreign service credit for his service in Vietnam. 2. He be awarded the Vietnam Service Medal (VSM). _________________________________________________________________ APPLICANT CONTENDS THAT: His DD Form 214, Armed Forces of the United States Report of Transfer or Discharge, does not reflect his temporary duty in Vietnam. However, he provides a copy of his evaluation for the reporting period of 18 May 66 to 17 May 67 that reflects a statement “… recently returned from a 60 day TDY in Southeast Asia where he was an asset to the maintenance team.” He believes he should be awarded any medals that he might be entitled to. In support of his request, the applicant provides a copy of a personal statement and a copy of his evaluation. His complete submission, with attachments, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant enlisted into the Regular Air Force on 17 May 66 and was progressively promoted to the grade of sergeant (E-4), having assumed that grade effective and with a date of rank of 1 Dec 68. Additional relevant facts pertaining to this application, extracted from the applicant’s military records, are contained in the letters prepared by the appropriate offices of the Air Force. Accordingly, there is no need to recite these facts in this Record of Proceedings. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPAPP recommends denial. DPAPP states that after a review of the applicant’s master personnel records and documentation provided, they were unable to substantiate foreign service in Vietnam. However, DPAPP was able to verify and confirm boots on ground foreign service at Naha Air Base, Okinawa, from 15 Oct 66 to 14 Apr 68. The applicant was asked to provide any documentation such as travel vouchers, evaluation reports, letters of evaluation, decorations, or other official military documents that reflect when and where the travel was completed, but the applicant did not respond. The DPAPP complete evaluation is at Exhibit C. AFPC/DPSIDR recommends denial. DPSIDR states they were unable to verify the applicant served on ground in Vietnam. Therefore, they cannot support this request. The DPSIDR complete evaluation is at Exhibit D. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: Copies of the Air Force evaluations were forwarded to the applicant on 26 Nov 10 for review and comment within 30 days. As of this date, this office has received no response. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinions and recommendations of the Air Force offices of primary responsibility and adopt their rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice.
