RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2010-01283 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: His records be corrected to reflect award of the Iraqi Campaign Medal (ICM) and 179 days be added to his Foreign Service time. _________________________________________________________________ APPLICANT CONTENDS THAT: He was deployed to Kuwait/Iraq in support of Operation Enduring Freedom from 12 Oct 05 to 9 Apr 06, for a total of 179 days. He was awarded the Iraqi Campaign Medal by a memorandum, dated 25 Mar 06. He desires the changes to establish eligibility for various educational grants and scholarships at institutions of higher learning. In support of his request, the applicant provides copies of deployment orders, ICM award letter, and a certificate of wartime service. The applicant's complete submission, with attachments, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant served in the Regular Air Force from 30 May 02 to 29 May 06. Eligibility for the ICM requires service members to have served in direct support of Operation Iraqi Freedom (OIF). The period of eligibility is on or after 19 Mar 03 to a future date to be determined by the Secretary of Defense or the cessation of OIF. Service members qualified for the Global War on Terrorism Expeditionary Medal (GWOT-E) by reasons of service between 19 Mar 03 and 28 Feb 05, in an area for which the ICM was subsequently authorized, shall remain qualified for that medal. Upon application, any such service members may be awarded the ICM in lieu of the GWOT-E for such service. No service members shall be entitled to both medals for the same deployment, action,achievement or period of service. Service members musthave been assigned, attached or mobilized to units operating in the area of eligibility for 30 consecutive days or for60 non- consecutive days or meet one of the following criteria: 1) Be engaged in combat during an armed engagement, regardless of the time in the area of eligibility; 2) While participating in an operation or on official duties, is wounded or injured andrequires medical evacuation from the area ofeligibility; 3) While participating as a regularly assigned aircrew member flying sorties into, out of, within or over the area of eligibility in direct support of the military operations; eachday of operations counts as one day of eligibility. AIR FORCE EVALUATION: HQ AFPC/DPSIDR recommends denial for award of the ICM. DPSIDR states they were unable to verify the applicant served in Iraq. However, HQ AFPC/DPAPP was able to verify the applicant was deployed to Kuwait from 22 Oct 05 to 10 Apr 06 and have indicated the applicant’s records will be administratively corrected to reflect this Foreign Service. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluationwas forwarded to the applicant on 1 Oct 10for review and comment within 30 days(Exhibit D). As of this date, this office has not received aresponse. THE BOARD CONCLUDES THAT: 1.The applicant has not exhausted all remedies provided by existing law or regulations. 2.Theapplication was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3.Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. We note the applicant provided documentation indicating he had fulfilled the requirements for award of the Iraqi Campaign Medal; however, wenote that upon application, any such service members may be awarded the Iraqi Campaign Medal in lieu of theGlobal War onTerrorism Expeditionary Medalfor such serviceand that no service members shall be entitled to both medals for the same 2 deployment, action,achievement or period ofservice.Given this fact, we note the applicant has not exhausted all his administrative remedies for award of the IraqiCampaign Medal. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the relief sought in this application. THE BOARD DETERMINES THAT: The applicant be notified that the evidence presented did not demonstrate the existence of material error or injustice; thatthe application was denied without a personal appearance; and that the application will only be reconsidered upon the submission of newly discovered relevant evidence not consideredwith this application.
