APPLICANT REQUESTS THAT: 

 

He be considered for promotion by a Special Selection Board (SSB) 
for the Calendar Year 2008 (CY08B) Lieutenant Colonel Central 
Selection Board (CSB) with his Meritorious Service Medal (MSM), 
First Oak Leaf Cluster (1OLC) included in his record.

STATEMENT OF FACTS: 

 

A similar appeal was considered and denied by the Board on 23 Jun 
09. For an accounting of the facts and circumstances surrounding 
the rationale of the earlier decision by the Board, see the 
Record of Proceedings at Exhibit D. 

 

Applicant’s record met the CY08B Lt Col CSB, and he was not 
selected for promotion. The MSM (1OLC) awarded for the period 
8 Jul 05 through 28 Jul 08 was not signed and entered into his 
record until 18 Nov 08. 

 

On 17 Sep 09, the applicant submitted a request for 
reconsideration and provided a letter of support from his then 
vice commander.

THE BOARD CONCLUDES THAT: 

 

After again reviewing this application and the evidence provided 
in support of his appeal, we are persuaded the applicant’s 
request for SSB should be granted. We note the processing of the 
decoration was in accordance with Air Force policy and was not 
required to be filed in his records prior to the CY08B CSB. 
However, in view of the vice commander’s statement, it appears it 
was his intent to have the MSM in the applicant’s official record 
prior to the convening of the promotion board, but extenuating 
operations requirements prevented it. As such, the applicant was 
not considered for promotion with the Officer Selection Record 
intended by his chain of command. Therefore, in order to provide 
the applicant fair and equitable relief and to preclude any 


possibility of an injustice, his records should be corrected as 
indicated below.

THE BOARD RECOMMENDS THAT: 

 

The pertinent military records of the Department of the Air Force 
relating to APPLICANT, be corrected to show that: 

 

 a. The Meritorious Service Medal (First Oak Leaf Cluster), 
with inclusive dates of 8 July 2005 through 28 July 2008, was 
approved on 7 September 2008, rather than 18 November 2008; and 
was accepted for file in his Officer Selection Record on 
8 September 2008. 

 

 b. It is further directed that the corrected record be 
considered for promotion to the grade of lieutenant colonel by a 
Special Selection Board for the Calendar Year 2008B (CY08B) 
Lieutenant Colonel Central Selection Board.
